Abstract

Notaris adalah pejabat umum yang harus menjalankan jabatannya secara professional. Sebagai pejabat umum yang berkewajiban melayani masyarakat dengan sungguh–sungguh maka Notaris tidak diperbolehkan memperlakukan dirinya sebagai pelaku usaha yang melakukan kegiatan–kegiatan promosi, baik dalam media cetak ataupun media elektronik sesuai dengan Pasal 4 ayat 3 Kode Etik Notaris. Walaupun hal ini telah secara jelas dilarang, namun ternyata masih ditemukan pelanggaran–pelanggaran yang terjadi.Guna mengetahui hal–hal tersebut maka penulis mempergunakan penelitian yuridis normatif, yaitu studi kepustakaan dengan metode analitis data adalah pendekatan kualitatif yang menyajikan data secara evaluatif – analistis. Peranan Dewan Kehormatan sebagai alat kelengkapan pengurus Ikatan Notaris Indonesia, Apabila ada anggota perkumpulan diduga melakukan pelanggaran terhadap Kode Etik Notaris, maka selambat-lambatnya dalam waktu 7 (tujuh) hari kerja Dewan Kehormatan wajib mengadakan sidang Dewan Kehormatan untuk membicarakan dugaan terhadap pelanggaran tersebut dan Dewan Kehormatan akan memangil anggota perkumpulan yang telah melanggar larangan tersebut. Dewan Kehormatan akan menentukan putusan mengenai terbukti atau tidaknya pelanggaran Kode Etik serta penjantuhan sanksi terhadap pelanggarnya setelah mendengar keterangan dan pembelaaan diri dari anggota perkumpulan yang bersangkutan dalam sidang Dewan Kehormatan, tetapi dalam kenyataannya organisasi Ikatan Notaris Indonesia (INI) sendiri tidak ada lembaga atau bidang khusus yang bertugas untuk mengecek dan memeriksa secara proaktif, agar dapat mengetahui pelanggaran- pelanggaran yang terjadi di internet berkaitan dengan promosi jabatan atau mengiklankan diri melalui website / Notary is a public official that must carry out their position professionally. As a public official who is obliged to serve the community seriously, a Notary is not permitted to treat themselves as businessmen who carry out promotional activities, whether in print or electronic media as accordance with Article 4 paragraph 3 of the Code of Ethics of Notary. Although this has been clearly prohibited, the violations still occur. In order to know these things, the authors use library research that is legal normative, with analytical methods of data and a qualitative approach that presents data evaluatively - analytically. The role of the Honorary Board as a board of management of the Indonesian Notary Association/Ikatan Notaris Indonesia (INI), if any member of the association is suspected of violating the Code of Ethics of Notary, no later than 7 (seven) working days, the Honorary Council shall convene an Honorary Council to discuss the alleged violation and the Honorary Council will summon the members of the association who have violated the prohibition. The Honorary Council will determine the decision regarding whether it was or was not violation of the Code of Ethics of Notary and the sanction of the violator after hearing statement and self-defense of the members of association in the Honorary Council session, however in reality the organization of the Indonesian Notary Association/Ikatan Notaris Indonesia (INI) itself has no department or specific division which is proactively in charge of checking and examining, in order to find out the violations that occur on the internet related to promotion or self-advertisement through the website
