Abstract

Pengaturan mengenai perkawinan poligami di Indonesia masih sangat terbatas, karena seyogyanya perkawinan hanya dilakukan sekali seumur hidup karena hubunganya yang kekal dan abadi. Perkawinan poligami boleh dilakukan apabila memenuhi persyaratan sesuai yang berlaku di Indonesia, salah satu persyaratanya ialah mendapatkan persetujuan isteri pertama, hal mana perkawinan poligami tidak memenuhi persyaratan. maka isteri pertama dapat mengajukan pembatalan perkawinan poligami yang tidak mendapatkan persetujuan isteri pertama. Di dalam penulisan ini mengungkap kasus pembatalan terhadap perkawinan poligami yang tidak mendapat presetujuan isteri pertama dan akibat nya terhadap harta perkawinan. Pokok permasalahan penelitiannya adalah: (1) Bagaimana Keabsahan Perkawinan Poligami yang dilaksanakan tanpa persetujuan istri pertama? (2)Bagaimana kedudukan harta perkawinan poligami yang tidak mendapat persetujuan istri pertama? Untuk menjawab permasalahan tersebut, penelitian hukum yang dilakukan normatif yang bersifat deskriptif. Dengan cara menganalisa Putusan Pengadilan Agama Nomor 2384/Pdt.G/2016/PA.Tsm. Dari penelitian tersebut dapat disimpulkan bahwa mengenai harta bersama dalam perkawinan poligami. isteri kedua dan seterusnya tidak mempunyai hak atas harta bersama yang telah ada sebelum perkawinan dengan isteri kedua atau berikutnya. / Regulations regarding polygamous marriages in Indonesia are still very limited, because marriages should only be done once in a lifetime because the relationship is eternal and eternal. Polygamous marriages may be carried out if they meet the appropriate requirements that apply in Indonesia, one of the requirements is to get the approval of the first wife, in which case polygamous marriages do not meet the requirements. then the first wife can apply for the annulment of a polygamous marriage that does not get the approval of the first wife. In this paper, it reveals cases of cancellation of polygamous marriages that do not get the approval of the first wife and the consequences for marital property. The main problems of the research are: (1) How is the legitimacy of polygamous marriages carried out without the consent of the first wife? (2) What is the position of the property of a polygamous marriage without the approval of the first wife? To answer these problems, the legal research carried out is normative with a descriptive nature. By analyzing the Religious Court Decision Number 2384/Pdt.G/2016/PA.Tsm. From this study it can be concluded that regarding joint property in polygamous marriages. the second wife and so on do not have the right to the existing joint property before the marriage with the second or subsequent wife.
