Abstract
Tesis ini membahas mengenai Perbandingan Hukum mengenai penerapan pengujian insolvensi Di Indonesia, pengujian insolvensi tidak diatur dalam Undang-Undang No. 37 tahun 2004 Tentang Kepailitan dan Penundaan Kewajiban Pembayaran Utang.PadahalUU Pailit tersebut, memiliki ratio legis yang mendukung perkembangan ekonomi di Indonesia, dimana dalam pembahasannya, penulis melandaskan pokok pembahasan dariUU Pailit dan perundang-undangan terkait lainnya. Beranjak dari peraturan perundang-undangan tersebut,dalam tesis ini penulis menekankan mengenai teori tujuan hukum untuk tercapainya keadilan, kemanfaatan dan kepastian hukum. Adapun dalam tesis ini, penulis juga memaparkan mengenai mekanisme dan bentuk PKPU maupun Pailit. Penelitian ini adalah penelitian normatif dengan sifat penelitian deskriptif analitis. Jenis data yang digunakan adalah data Primer dengan analisis data pendekatan kualitatif. Dalam hal ini, debitoryang dimohonkan pailit oleh kreditor perlu mendapatkan kesempatan yang sama dalam artian debitor sebelum adanya putusan pailit atau PKPU harus diterapkannya pengujian insolvensi terlebih dahuluagar mendapatkan perlindungan dan kepastian hukum di mata hukum./This thesis discusses the Comparison Law regarding the application of insolvency test In Indonesia, insolvency test is not regulated in Law no. 37 of 2004 concerning Bankruptcy and Suspension of Debt Payment Obligations. In fact, the Bankruptcy Law has a legislative ratio that supports economic development in Indonesia, where in the discussion, the author bases the discussion on the Bankruptcy Law and other related legislation. Moving on from the legislation, in this thesis the author emphasizes the theory of legal objectives to achieve equity, benefit and legal certainty. As for this thesis, the author also describes the mechanism and form of PKPU and Bankruptcy. This research is a normative research with descriptive analytical research. The type of data used is primary data with a qualitative approach to data analysis. In this case, the debtor who is petitioned by creditor for bankruptcy needs to get the same opportunity, in the sense that the debtor before the bankruptcy decision or PKPU must apply insolvency test first in order to obtain legal protection and certainty in the eyes of the law.
