Abstract

A Notary is a public official authorized to make authentic deeds regarding all acts, agreements, and provisions required by legislation and/or desired by those concerned to be stated in authentic deeds as stipulated in the provision of the Repubic of Indonesian law number 2 year 2014 concerning changes to the laws of the Republic of Indonesia number 30 year 2004 concerning the position of Notary (UUJN). Furthermore, in Article 16 of the UUJN states that one of the obligations of the Notary is to act honestly, thoroughly, impartially and safeguard the interests of parties related to grosse deeds and quotations of deeds based on minuta deeds. The Notary must also know the limits of responsibility and authority in carrying out his position so that the Notary and the parties facing him can avoid problems that may arise in the future. In the case study examined by the author, the viewer came to the Notary to make a deed which according to his statement the viewer had obtained the verbal power, even though the verbal power was never given, but the Notary kept issuing the deed at the request of the respondent. Although juridically there is no prohibition on the use of verbal power, the fact is that the use of verball power is very risky for the process of proof, namely there is still the possibility of denial of certain parties to the existence of the verbal power, and the Notary cannot prove the verbal power. In carrying out his position, the Notary ignores the precautionary principle that already exists in UUJN Article 16 and the Notary Professional Code of Ethics, so that the Notary Court concerned is declared null and void / never occurs and the Notary is asked to be responsible for his negligence. In this study the author uses the Normative Juridical research method, then analyzed using Qualitative research types. / Notaris adalah Pejabat Umum yang berwenang untuk membuat Akta Otentik mengenai semua perbuatan, perjanjian dan ketetapan yang diharuskan oleh Peraturan Perundang-undangan dan/atau yang dikehendaki oleh yang berkepentingan untuk dinyatakan dalam akta otentik sebagaimana diatur dalam Ketentuan Undang-Undang Republik Indonesia Nomor 2 Tahun 2014 Tentang Perubahan Atas Undang-Undang Republik Indonesia Nomor 30 Tahun 2004 Tentang Jabatan Notaris (UUJN). Selanjutnya, dalam Pasal 16 UUJN menyebutkan bahwa salah satu kewajiban Notaris adalah bertindak jujur, seksama, tidak berpihak dan menjaga kepentingan pihak yang terkait grosse akta dan kutipan akta berdasarkan minuta akta. Notaris juga harus mengetahui batasan tanggung jawab dan wewenang dalam menjalankan jabatannya agar Notaris dan para pihak yang menghadap terhindar dari permasalahan yang dapat timbul dikemudian hari. Dalam studi kasus yang diteliti oleh penulis, penghadap datang ke Notaris untuk membuat akta yang mana menurut keterangannya penghadap telah mendapatkan kuasa secara lisan, padahal kuasa lisan tersebut tidak pernah diberikan, namun Notaris tetap menerbitkan akta sesuai permintaan penghadap. Meskipun secara yuridis tidak terdapat larangan penggunaan kuasa lisan namun faktanya penggunaan kuasa lisan sangat beresiko terhadap proses pembuktiannya, yaitu masih terdapat kemungkinan sangkalan pihak tertentu atas keberadaan kuasa lisan tersebut, dan Notaris tidak dapat membuktikan kuasa lisan tersebut. Dalam menjalankan jabatannya Notaris mengabaikan prinsip kehati-hatian yang sudah ada dalam UUJN Pasal 16 dan Kode Etik Profesi Notaris, sehingga oleh Pengadilan akta Notaris yang bersangkutan dinyatakan batal demi hukum. Notaris diminta untuk bertanggung jawab atas kelalaiannya tersebut. Pada penelitian ini menggunakan metode penelitian Yuridis Normatif, kemudian dianalisa menggunakan jenis penelitian Kualitatif.
