Abstract

Notaris memiliki wewenang dalam membuat akta-akta otentik, dan juga Notaris harus menjamin otentitas pada akta yang dibuatnya. Sebagai pejabat pembuat akta otentik, maka Notaris tidak boleh keluar dari koridor yang telah ditentukan dalam undang- undang yang berlaku. Akta notaris merupakan perjanjian antara para pihak yang mengikat antar mereka yang membuatnya, maka dari itu suatu perjanjian harus memenuhi syarat-syarat sah sesuai dengan ketentuan Pasal 1320 KUHPerdata. Penelitian ini bertujuan untuk mengetahui bagaimana keabsahan akta perjanjian pinjam nama atau nominee agreement di Indonesia apabila melanggar hukum hukum di Indonesia serta bagaimana tanggung jawab notaris apabila akta pinjam nama atau nominee agreement yang dibuat oleh notaris berindikasai melakukan perbuatan melawan hukum. Metode yang digunakan dalam penelitian ini adalah Penelitian Hukum Normatif dengan jenis penelitian yuridis normatif yang dilakukan dengan cara deskriptif analitis. Perlu diketahui bahwa akta-akta atau perjanjian yang dibuat oleh notaris dengan dasar itikad tidak baik maka akan batal demi hukum karena melanggar salah satu syarat perjanjian yaitu suatu causa yang halal. Maka segala perjanjian nominee yang dibuat antara warga negara asing dengan warga negara Indonesia akan batal demi hukum, serta tanah yang menjadi obyeknya akan menjadi milik Negara. Notaris sebagai pejabat umum yang beerwenang dalam membuat aktanya akan dijatuhi sanksi baik secara administrasi, perdata, pidana, maupun dengan kode etik./ Notary have the authority to make authentic deeds, and also notary must guarantee the authenticity of the deeds they make. As the official making the authentic deed, the Notary may not leave the corridor that has been determined in the applicable law. A notarial deed is an agreement between the parties that is binding between those who made it, therefore an agreement must meet the legal requirements in accordance with the provisions of Article 1320 of the Civil Code.This study aims to determine the validity of the nominee agreement deed in Indonesia if it violates Indonesian law and how the notary's responsibility is if the name borrowing agreement or nominee agreement made by a notary is indicative of committing an unlawful act. The method used in this research is normative legal research with normative juridical research which is carried out by analytical descriptive method. It should be noted that deeds or agreements made by a notary on the basis of bad faith will be null and void by law because they violate one of the terms of the agreement, namely a lawful cause. Then all nominee agreements made between foreign citizens and Indonesian citizens will be null and void by law. and the land that becomes the object will become the property of the State. Notary as public officials who are authorized to make the deed will be subject to sanctions both administratively, civilly, criminally, as well as with a code of ethics.
