Abstract

Penelitian ini membahas mengenai perlindungan hukum yang diberikan oleh Undang-undang Perlindungan Konsumen, Kitab Undang-undang Hukum Perdata, dan Undang-undang Jabatan Notaris terhadap Klien dalam menggunakan jasa hukum Notaris yang memalsukan tanda tangan dan bagaimana tanggung jawab Notaris kepada Klien dalam beberapa bentuk. Dan juga akibat hukum bagi Notaris yang melanggar kode etik. Pembahasan dalam penelitian ini meliputi aspek-aspek yuridis, seperti pengertian konsumen dan pelaku usaha, hubungan antara klien dan Notaris, dan pertanggungjawaban Notaris tersebut terhadap kerugian yang dialami oleh klien, serta perlindungan hukum yang diberikan oleh ketiga undang-undang tersebut secara khusus, baik secara pidana maupun secara perdata. Metode yang digunakan adalah yuridis normatif, sedangkan metode analisis data menggunakan metode kualitatif. Hasil penelitian menyimpulkan bahwa perlindungan hukum yang diberikan oleh ketiga undang-undang tersebut sudah cukup memadai secara perdata, namun masih banyak kekurangan dalam memberikan perlindungan secara pidana kepada klien atas jasa hukum yang dimanfaatkannya. / This thesis analyzes the protections given by particular laws, such as Consumer Protection Act, Civil Code, and Notary Act toward consumer of whom using notary’s law service who fake the signs and how the responsibility from notary to consumer. The comprehension in this thesis consists juridical aspects, such as definition of consumer and merchant, relation between client and notary, and the protection given by those three acts specifically, from civil aspect as well as criminal aspect. And how Notary get the responsibilites from code of ethic Notary act toward. And how this writers give the advice from the thesis. This thesis uses juridical norms approach as research implementation method as well as qualitative method in data assessment. The conclusion of this thesis is the protection given by those acts is pleasing in civil aspect, but from criminal law aspect, it still has many weaknesses in protecting consumer who utilize the law service.
