Abstract

Tujuan penelitian ini untuk mengkaji mengenai perlindungan hukum terhadap Notaris Penerima Protokol dan tanggung jawab terhadap pelanggaran dalam pembuatan akta yang dilakukan notaris pemberi protokol yang telah diberhentikan dri jabatannya.Metode penelitian yang digunakan dalam karya tulis ini adalah Penelitian ini merupakan penelitian normatif empiris yang menggunakan data sekunder dan data primer melalui penelitian kepustakaan. Penelitian ini menunjukkan bahwa dalam pemberian protokol notaris, seharusnya mengikuti prosedur yang telah ditentukan dalam Undang-undang Jabatan Notaris dan Kode Etik Notaris dan diperlukannya aturan mengenai perlindungan hukum atas pemberian protokol notaris karena saat ini belum adanya aturan mengenai perlindungan hukum terhadap notaris penerima prokol dan apabila seorang notaris yang diberhentikan dari jabatannya maka notaris tersebut dilarang membuat akta otentik karena akan menyebabkan kedudukan atas akta yang dibuatnya menjadi terdegradasi atau akta dibawah tangan dan dapat merugikan klien yang membuat akta padanya. / The purpose of this study is to examine the Legal Protection of The Notary Recipient of The Protocol and the responsibility for violations in making of the deed carried out by the notary giving the protocol who has been dismissed from their position. This research method in this paper is an empirical normative research using secondary data and primary data. This study shows that in The Provision of a Notary Protocol, should follow the specified procedures in The Notary Position Act and The Notary Code of Ethics and the need for rules regarding legal protection notaries who receive protocols and if the notary who is dismissed from this position, the notary itself prohibited from making an authentic deed because it will cause the position of the deed they made to be degraded or the deed under the hand and van harm the client who made the deed to them.
