Abstract

Tujuan Penelitian ini adalah untuk menjelaskan, menganalisis, dan memperdalam pengetahuan hukum mengenai status kepemilikan satuan rumah susun yang pembeliannya didasarkan pada Akta Perjanjian Pengikatan Jual Beli akibat kepailitan Pelaku Pembangunan Rumah Susun dan untuk menjelaskan, menganalisis dan memperdalam pengetahuan hukum mengenai peran Notaris dalam membuat Akta PPJB sebagai bentuk perlindungan hukum kepada Pembeli satuan rumah susun. Dengan memakai metode penelitian hukum yuridis normatif dapat diambil kesimpulan : 1. Status kepemilikan satuan rumah susun yang pembeliannya didasarkan pada Akta PPJB adalah milik Pelaku Pembangunan Rumah Susun yang menjadi bagian dari harta pailit, sehingga menyebabkan Pembeli menjadi Kreditur Konkuren. 2. Peran Notaris adalah memberikan perlindungan hukum yang bersifat preventif dengan melakukan kewenangan dan kewajibannya dalam pembuatan Akta PPJB yang mengacu pada peraturan perundang-undangan, memberikan penyuluhan hukum, serta bertindak amanah, jujur, saksama, mandiri tidak berpihak, dan menjaga kepentingan para pihak / The purpose of this study is to explain, analyze, and explore the legal knowledge regarding the ownership status of apartment unit which is bought through Binding to Sale and Purchase Agreement (PPJB) Deed due to the bankruptcy of the Apartment Developer and to explain, analyze, and explore the legal knowledge regarding the role of the Notary in making the PPJB Deed in order to provide a legal protection for the Buyer of the apartment unit. By using a normative juridical research method, it can be concluded : 1. The ownership status of the apartment unit which the purchase is through the PPJB Deed belongs to the Apartment Developer which is a part of the bankrupt assets, therefore it causes the Buyer to become a Concurrent Creditors. 2. The role of the Notary is to provide a preventive legal protection by acting on his/her authority and obligation in making the PPJB Deed in accordance to the laws and regulations, provide a legal counseling, as well as acting responsibly, honestly, thoroughly, independently, impartialy, and protecting the interests of the parties
