Abstract

Penelitian ini bertujuan untuk mengetahui pengaturan mengenai kewenangan Notaris dalam melakukan penyuluhan hukum mengenai Hak Kekayaan Intelektual (HKI) sebagai objek jaminan fidusia dan mengetahui pelaksanaan peran serta notaris dalam memberikan penyuluhan hukum untuk meningkatkan pemahaman masyarakat di bidang itu. Metode penelitian yang digunakan adalah metode penelitian hukum normatif yang didukung dengan kajian empiris dan bersifat deskriptif kualitatif dengan menggunakan pendekatan perundang-undangan dan pendekatan konseptual. Sumber data yang digunakan meliputi bahan hukum primer, sekunder dan tersier. Hasil penelitian menunjukan bahwa terdapat korelasi fungsional antara notaris dengan bidang hukum HKI, khususnya dalam melakukan penyuluhan hukum mengenai HKI sebagai objek jaminan fidusia. Sejauh ini, peran serta notaris dalam melakukan penyuluhan hukum di bidang hukum HKI sebagai objek jaminan fidusia masih terbatas karena pengetahuan dan keahlian Notaris mengenai HKI yang tidak mendalam dan memadai. Oleh karena itu, seiring dengan kemajuan ekonomi dan perdagangan, Notaris dituntut untuk melengkapi diri dengan pengetahuan hukum bisnis, khususnya hukum HKI./This research is conducted to know the regulation regarding the authority of a Notary in conducting legal counseling concerning Intellectual Property Rights (IPR) as an object of fiduciary guarantee and to know the implementation of the role of a Notary in providing legal counseling to increase public understanding in that field. This research method used is a normative legal research method which is supported by empirical studies and is descriptive qualitative by using a statutory approach and a conceptual approach. The data sources used are primary, secondary, and tertiary legal materials. The results of this research indicate that there is a functional correlation between Notary and the field of IPR Law, especially in conducting legal counseling regarding IPR as an object of fiduciary guarantee. So far, the role of a Notary in conducting legal counseling in the field of IPR law as an object of fiduciary guarantee is still limited because the knowledge and expertise of a Notary regarding IPR is not deep and adequate. Therefore, along with economic and trade progress, Notary are required to equip themselves with knowledge of business law, especially IPR law.
