Abstract

Tanah pada dasarnya diperuntukan untuk seluas-luasnya kemakmuran rakyat sebagaimana diamanatkan dalam Undang-Undang Dasar Negara Republik Indonesia Tahun 1945. Dengan begitu, tanah sudah semestinya bermanfaat bagi masyarakat luas di tiap-tiap wilayah. Namun, dalam realitanya belum semua tanah memberikan manfaat bagi masyarakat karena berbagai macam faktor. Salah satu faktornya adalah tidak produktifnya tanah di wilayah yang melakukan pemekaran, serta kurangnya dana pemerintah untuk membiayai pembangunan atas tanah tersebut. Objek penelitian dalam tesis ini adalah bekas Terminal Cilembang yang terletak di Kota Tasikmalaya, di mana semula tanah tersebut terletak di wilayah Kabupaten Tasikmalaya dan hingga saat ini masih menjadi aset Pemerintah Kabupaten Tasikmalaya. Objek penelitian tersebut hingga saat ini dikatakan menjadi aset ‘gono-gini’ karena merupakan aset Kabupaten Tasikmalaya yang secara lokasi sudah berada di Kota Tasikmalaya akibat pemekaran wilayah. Atas permasalahan tersebut, maka salah satu solusinya adalah Build Operate Transfer (BOT) yang merupakan perjanjian kerjasama yang melibatkan pemerintah sebagai pemilik tanah dan investor yang merupakan pihak swasta sebagai penyedia dana. Dalam pelaksanaan BOT di wilayah pemekaran, pendataan aset sangatlah diperlukan agar kedepannya tidak terjadi permasalahan dalam pelaksanaan BOT. / The land is intended for the broadest possible prosperity of the people as mandated in the 1945 Constitution of the Republic of Indonesia. Thus, land should be beneficial to the wider community in each region. However, in reality, not all land provides benefits to the community due to various factors. One of the factors is the unproductive land in the area undergoing expansion, as well as the lack of government funds to finance the development of the land. The object of research in this thesis is the former Cilembang Terminal located in Tasikmalaya City, where the land was originally located in the Tasikmalaya Regency area and is still an asset of the Tasikmalaya Regency Government. The object of this research is said to be a 'gono-gini' asset because it is an asset of the Tasikmalaya Regency which is already located in the City of Tasikmalaya due to the expansion of the region. For these problems, one solution is Build Operate Transfer (BOT) which is a cooperation agreement involving the government as the land owner and investors who are private parties as providers of funds. In the implementation of BOT in the expansion area, asset data collection is very necessary so that in the future there will be no problems in the implementation of BOT.
