Abstract

Seiring dengan perkembangan zaman yang begitu pesat disertai penggunaan tanah yang tidak maksimal, pihak investor bekerja sama dengan pemilik tanah menjalankan konsep Build Operate Transfer (BOT) di atas tanah Hak Pengelolaan (HPL). Pendanaan yang semakin besar akan menghasilkan proyek yang semakin maksimal, untuk itu sering kali pihak investor menjaminkan objek BOT di atas tanah HPL. Namun hingga saat ini, belum ada peraturan perundang-undangan khusus yang mengatur BOT, HPL dan penjaminan objek BOT di atas tanah HPL. Metode penelitian yang digunakan adalah penelitian yuridis normatif dengan pendekatan perundang- undangan dan analitis, pengumpulan data dilakukan dengan menggunakan data sekunder berupa bahan hukum primer, sekunder dan tersier sebagai data utama. Data-data yang diperoleh kemudian diolah, dianalisis dan ditafsirkan secara logis dan sistematis. Dari hasil penelitian diketahui bahwa belum ada peraturan perundang-undangan yang mengatur secara spesifik mengenai konsep perjanjian BOT, HPL dan penjaminan objek BOT di atas tanah HPL, pelaksanaannya masih berpedoman pada Pasal 1320 dan Pasal 1338 KUHPerdata, serta pengaturan konsep perjaminan secara umum. Notaris berperan penting dalam penjaminan hak atas tanah sebagai objek BOT di atas tanah HPL yaitu dalam pembuatan akta perjanjian kredit, SKMHT dan memberikan penyuluhan hukum terhadap konsep penjaminan bersifat khusus terhadap objek BOT di atas tanah HPL tersebut / Along with the rapid development and land that is not utilized optimally, the investor in collaboration with the land owner to using the concept of Build Operate Transfer (BOT) over management right’s land (HPL). Increasing funding will result in projects that are getting more leverage, so that the private sector often secure BOT objects over HPL. However, there are no specific laws and regulations that regulate BOT, HPL and security of object of BOT over HPL. The research used judicial normative with stature approach and analytical approach, the data were gathered by using secondary data which consisted of primary, secondary, and tertiary legal materials as the main data. The gathered data were processed, analyzed, and interpreted logically and systematically. From the results of the study, it is known that there is no specifically regulates the concept of BOT and HPL agreements, and also security of object of BOT over HPL, its implementation is still guided by Article 1320 and Article 1338 of the Civil Code, as well as general securities concept arrangements. The notary has an important role in security of land rights as BOT objects over HPL, namely in making credit deed agreements, SKMHT and providing legal counsel to the concept of securities specifically for BOT objects over HPL
