Abstract

Pasal 86 Peraturan Pemerintah Republik Indonesia Nomor 18 Tahun 2021 menyatakan “Pembuatan Akta PPAT dapat dilaksanakan secara elektronik”. Peraturan Pemerintah tersebut membuat pembuatan akta di Indonesia memiliki dua cara yaitu secara konvensional dan secara elektronik tetapi implementasi Pasal 86 Peraturan Pemerintah Republik Indonesia Nomor 18 Tahun 2021 masi sangat rentan karena tidak ada aturan perundang-undangan mengenai tata cara pembutan akta Notaris maupun akta Pejabat Pembuat Akta Tanah (PPAT) secara elektronik sehingga pembuatan akta Notaris maupun akta Pejabat Pembuat Akta Tanah (PPAT) yang seharusnya menjadi akta yang otentik yang memiliki kekuatan eksekutorial sebagai alat bukti yang sah terdegreadsi menjadi akta dibawah tangan karena tata caranya tidak sesuai dengan peraturan perundang-undangan. Pembuatan akta yang dilakukan secara elektronik ini terhalang oleh kewajiban pembuat akta dan saksi-saksi hadir secara fisik dan dengan segera menandatangani akta tersebut di depan pejabat pembuat akta, para pembuat akta dan saksi-saksi dalam pembuatan akta tersebut. Namun hal ini dapat di implementasikan dalam pembuatan salinan akta dan salinan akta tersebut dapat menjadi alat bukti yang sah dalam persidangan./Article 86 of Government Regulation of the Republic of Indonesia Number 18 of 2021 states "Making PPAT deeds can be carried out electronically". This Government Regulation makes deed making in Indonesia be in two ways, namely conventionally an delectronically, but the implementation of Article of Government Regulation of the Republic of Indonesia Number 18 of 2021 is still very vulnerable because there are no statutory regulations regarding the procedures for making Notary deeds and Land Deed Official (PPAT) deeds electronically, so the making of Notary deeds and Land Deed Official (PPAT) deeds which should beauthentic deeds with executorial power as valid evidence is degenerated into underhand deeds because the procedures are not inaccordance with statutory regulations. This electronic deed making is hindered by the obligation of the deed makers and witness estobe physically present and immediately sign the deeds before deed maker officials, the deed makers and witnessesin the deed making. However, this can be implemented in making a copy of the deed, and the said copy of the deed can be valid evidence in court.
