Abstract

Akta Perjanjian Pengikatan Jual Beli yang dibuat Notaris mengalami cacat hukum karena didalam akta tersebut dalam pembuatannya terdapat klausula kuasa mutlak serta tidak dibacakan oleh Notaris, pencantuman harga yang tidak sesuai dengan kesepakatan yang telah disepakati oleh para pihak, dan juga Akta Jual Beli yang dibuat oleh PPAT juga terdapat kesalahan karena pihak yang menghadap bertindak atas dasar Surat Kuasa Mutlak dan pihak tersebut memenuhi syarat untuk bertindak melakukan pemindahan hak atas suatu tanah. Penelitian ini membahas kasus yang terdapat dalam Putusan Pengadilan Negeri Palembang Nomor 56/Pdt.G/2020/ PN.PLG, yang dimana terdapat gugatan terhadap Pembeli tanah/bangunan, Notaris dan PPAT yang melakukan perbuatan melawan hukum dalam pembuatan Akta Perjanjian Pengikatan Jual Beli yang terdapat Klausul Kuasa Mutlak, pencantuman harga yang tidak sesuai dan Akta Jual Beli dimana pihak-pihak yang menghadap tidak sesuai dengan kapasitasnya sebagai Pembeli yang sah karena belum melakukan pelunasan pembayaran terhadap tanah/bangunan serta akta yang tidak dibacakan didepan penghadap. Adapun permasalahan yang diambil adalah perbuatan hukum jual beli tanah beserta bangunan yang didasarkan pada Perjanjian Pengikatan Jual Beli (PPJB) serta pertimbangan Hakim pada perkara Putusan Pengadilan Negeri Palembang Nomor 56/Pdt.G/2020/PN.PLG. Untuk menjawab permasalahan tersebut digunakan metode hukum normatif. Adapun Analisa data dilakukan secara preskriptif. Hasil Analisa adalah Notaris dan PPAT dalam pembuatan akta tidak sesuai dengan peraturan perundang-undangan. / The Deed of Sale and Purchase Agreement made by a Notary is legally flawed because in the deed there is an absolute power of attorney clause and is not read out by the Notary, the inclusion of a price that is not in accordance with the agreement that has been agreed upon by the parties, and also the Sale and Purchase Deed made by PPAT there is also an error because the party facing it acts on the basis of an Absolute Power of Attorney and the party fulfills the requirements to act to transfer rights to a land. This study discusses the case contained in the Palembang District Court Decision Number 56/Pdt.G/2020/PN.PLG, in which there is a lawsuit against the land/building buyer, Notary and PPAT who committed an unlawful act in the making of the Sale and Purchase Binding Agreement Deed. there is an Absolute Power Clause, the inclusion of an inappropriate price and the Deed of Sale and Purchase where the parties who appear are not in accordance with their capacity as legal buyers because they have not made payment for the land/building as well as the deed which was not read out in front of the appearer. The problem taken is the legal act of buying and selling land and buildings based on the Sale and Purchase Binding Agreement (PPJB) and the judge's considerations in the case of the Palembang District Court Decision Number 56/Pdt.G/2020/PN.PLG. To answer these problems, the normative legal method is used. The data analysis was carried out prescriptively. The result of the analysis is that the Notary and PPAT in making the deed are not in accordance with the laws and regulations.
