Abstract

Seiring perkembangan globalisasi, salah satu praktik HKI yang masih tergolong abu-abu dan hingga saat ini masih diperdebatkan di dunia internasional adalah praktik impor paralel. Terkait praktik ini, peranan merek tidak dapat dipisahkan. Isu praktik impor paralel merupakan praktik dimana barang-barang asli yang diperoleh dari luar negeri secara sah, kemudian dibawa masuk ke Indonesia untuk tujuan komersial, tanpa sepengetahuan dan persetujuan pemilik merek atau pemegang lisensi yang sah atas merek produk tersebut di Indonesia. Pada umumnya, harga yang ditawarkan juga jauh lebih murah dan kompetitif. Namun, di sisi lain, praktik ini juga dapat merusak kualitas dan reputasi pemilik merek itu sendiri. Permasalahan impor paralel dan sengketa merek dalam HKI tidak dapat dilepaskan dari doktrin exhaustion right dan first sale rule. Beberapa negara telah menerapkan aturan mengenai praktik ini. Oleh karena itu, penting bagi negara berkembang seperti Indonesia untuk menerapkan aturan hukum yang pasti mengenai praktik tersebut untuk menjamin kepastian hukum. Permasalahan yang penting timbul adalah keterkaitan doktrin exhaustion dan first sale rule terhadap praktik impor paralel dan regulasi negara ini menangani praktik impor paralel tersebut. / Along with the globalization development, one of the practices of Intellectual Property Rights related to trademark which still classified as gray market and is still debated in the international world is the practice of parallel imports. The issue of parallel import practices is where the original goods obtained legitimately from abroad then brought into Indonesia for commercial purposes, without the knowledge and approval of the trademark owner or even legal license holder of the trademark in Indonesia. In general, the price offered is also much cheaper and competitive. However, on the other hand, this practice can also damage the quality and reputation of the trademark owner itself. The issue with parallel imports and trademark disputes in Intellectual Property Rights cannot be separated from the exhaustion doctrine and first sale rule. Some countries have implemented rules regarding this practice. The important issue that arises is the connection of exhaustion doctrine and first sale rule to the practice of parallel imports and the regulation of this country to handle the practice of parallel imports. Therefore, it is important for developing countries like Indonesia to implement definite legal rules regarding these practices to ensure legal certainty.
