Abstract

Sebagai suatu Global Performance Indikator (GPI), Indeks Kemudahan Berusaha (Ease of Doing Business-EoDB) yang diterbitkan oleh World Bank Group telah menjadi salah satu pedoman terpenting bagi banyak negara untuk menentukan arah kebijakan Reformasi Regulasi dalam meningkatkan daya saing. Indonesia tidak terkecuali, sejak 2011 target peningkatan Indeks Kemudahan Berusaha telah muncul dalam berbagai agenda perencanaan strategis nasional dan disinggung dalam berbagai komitmen politik, sampai akhirnya penerbitan Indeks EoDB resmi dihentikan akhir 2021. Penelitian ini mencoba mempelajari proses dan agenda Reformasi Regulasi dalam bidang Hukum Ekonomi selama periode 2015-2020 dalam rangka meningkatkan peringkat Indonesia dalam Indeks EoDB. Hal ini dilakukan dengan melakukan studi literatur, empiris, historis dan komparatif terhadap kinerja reformasi regulasi Indonesia pada sektor hukum ekonomi dan membandingkannya dengan parameter yang ada pada setiap pada Indikator-indikator Indeks EoDB dengan indeks hukum, yang meliputi Starting a Business, Protecting Minority Investors, Getting Credits, Enforcing Contract dan Resolving Insolvency. Hasil penelitian menunjukkan bahwa pengaruh Indeks EoDB terhadap reformasi hukum ekonomi adalah signifikan dan bahkan berhasil mendorong pergerakan masif dalam sektor hukum ekonomi. Namun penelitian ini juga mencatat, bahwa Indeks EoDB bukanlah jawaban akhir bagi arah pembangunan hukum ekonomi, karena sebagaimana suatu GPI, Indeks EoDB memiliki keterbatasan dalam mengakomodasi situasi global dan terkadang harus berkompromi dengan situasi khusus di negara tertentu. Dalam mendorong Reformasi Regulasi Hukum Ekonomi secara paripurna, pemerintah ke depannya harus berpikir melebihi indikator yang ada pada GPI manapun dalam melaksanakan Reformasi Regulasi dengan melihat bagaimana agenda yang sama dilakukan di negara lain, dan pilihan kebijakan yang diambil. Kata Kunci : Reformasi Regulasi, Kemudahan Berusaha, Hukum Ekonomi, Memulai Usaha, Memperoleh Kredit, Perlindungan Investor Minoritas, Penegakan Kontrak, Penyelesaian Kepailitan/   ABSTRACT As a Global Performance Indicator (GPI), the Ease of Doing Business (EoDB) Index published by the World Bank Group has become one of the most important guidelines for many countries to determine the direction of Regulatory Reform policies in increasing competitiveness. Indonesia is no exception, since 2011 the target of increasing the Ease of Doing Business rank has been mentioned in various National Strategic Planning agendas and various political commitments, until it was discontinued at the end of 2021. This research tries to study the Regulatory Reform process and agenda in the field of Economic Law during 2015-2020 period in order to improve Indonesia's rank in the EoDB Index. This is done by conducting a literature, empirical, historical and comparative study of the performance of Indonesia's regulatory reform in the economic law sector and comparing it with the parameters in each of the EoDB Index Indicators with the legal index, which includes Starting a Business, Protecting Minority Investors, Getting Credits, Enforcing Contracts and Resolving Insolvency. The results show that the EoDB Index has a significant effect on Indonesia’s economic law reform and has even succeeded in driving massive movements in the economic law sector. However, this study also notes that the EoDB Index is not the final answer to the direction of economic law development, because like other GPI, EoDB Index aims to accommodate global situations and sometimes has to compromise with the specific situation in certain countries. In searching for meaningful economic law reform, the government in the future must think beyond any GPI by looking at how the samilar agenda is carried out in other jurisdiction, and the policy choices taken.
