Abstract

Kebebasan berkumpul dan berserikat di Indonesia dijamin dan diatur dalam Pasal 28E ayat (3) UUD 1945, kebebasan tersebut tidak hanya bagi setiap warga negara Indonesia, tetapi juga bagi setiap orang yang artinya termasuk juga warga negara asing yang berada di Indonesia. Wujud dari kebebasan berkumpul dan berserikat bagi warga negara asing, yaitu dimungkinkannya warga negara asing untuk mendirikan Yayasan. Hal tersebut dalam ketentuan Undang-Undang Yayasan dan Undang-Undang Ormas, kedua ketentuan tersebut memberikan pengaturan yang berbeda, khusunya mengenai tata cara dan persyaratan pendirian badan hukum Yayasan yang didirikan oleh warga negara asing. Dalam prakteknya hal tersebut menimbulkan kebingungan dan ketidakpastian hukum dalam masyarakat, bahkan dalam beberapa hal pengaturan yang berlaku melalui Undang-Undang Ormas memberikan kesan adanya diskriminasi dalam pendirian Yayasan yang didirikan oleh warga negara Indonesia dan Yayasan yang didirikan oleh warga negara asing. Kata Kunci : Yayasan Yang Didirikan Oleh Warga Negara Asing/ The freedom of assembly and association in Indonesia is guaranteed and regulated in Article 28E paragraph (3) of the 1945 Constitution. The freedom is not only for every Indonesian citizen, but also for everyone, which means including foreign nationals residing in Indonesia. The form of freedom of assembly and association for foreign nationals, namely the possibility of foreign citizens to establish a Foundation. This is stated in Foundation Law and the Law of Community Organizations, the two provisions provide different arrangements, especially regarding the procedures and requirements for establishing a foundation by foreign citizens. In practice, this creates confusion and legal uncertainty in society, even in some cases the regulations that apply through the Law of Social Organizations give the impression of discrimination in the establishment of foundations by Indonesian citizens and foundations established by foreign citizens.
