Abstract

Salah satu cara untuk mencegah pencemaran air sungai yang diakibatkan oleh limbah pewarnaan bahan sintetis adalah dengan menerapkan skema Ekolabel Tekstil/Produk Tekstil (TPT) yang mendorong masyarakat baik pelaku usaha TPT maupun konsumen TPT untuk berpartisipasi aktif dalam pelestarian air sungai melalui pola konsumsi dan produksi yang berkelanjutan. Penulis membahas relevansi Ekolabel TPT dalam mendukung pola Konsumsi dan Produksi Berkelanjutan yang merupakan Tujuan Pembangunan Berkelanjutan (Sustainable Development Goal) ke-12, implementasi peraturan Ekolabel TPT, dan strategi pengaturan Ekolabel TPT di Indonesia yang memanusiakan manusia sesuai dengan volksgeist bangsa Indonesia. Disertasi ini adalah penelitian hukum normatif dilengkapi pendekatan empiris dengan cara meneliti data sekunder yang terdiri dari bahan hukum primer, bahan hukum sekunder, bahan hukum tersier dan bahan non-hukum. Data primer diperoleh dari kuesioner, Diskusi Kelompok Terarah atau Focus Group Discussion (FGD) dan wawancara. Penelitian ini menggunakan pendekatan perundang-undangan, pendekatan perbandingan hukum, pendekatan sejarah hukum dan pendekatan filsafat hukum. Metode analisis yang digunakan adalah metode analisis kualitatif dan metode analisis kuantitatif. Berdasarkan hasil penelitian, skema Ekolabel Tekstil/Produk Tekstil (TPT) diperlukan untuk mendukung Konsumsi dan Produksi Berkelanjutan karena Ekolabel TPT selaras dengan hukum lingkungan internasional terkait Pembangunan Berkelanjutan, selaras dengan Konstitusi negara Republik Indonesia serta peraturan perundang-undangan terkait Pembangunan Berkelanjutan, dan selaras dengan aspek spiritual serta aspek material yang bersumber dari Sila Pertama dan Sila Kedua Pancasila. Implementasi peraturan Ekolabel TPT di Indonesia belum efektif dan belum efisien, sehingga membutuhkan strategi pengaturan seperti koordinasi antara Kementerian Lingkungan Hidup dan Kehutanan baik dengan pihak-pihak internal maupun pihak-pihak eksternal, dan pemberian insentif kepada pelaku usaha TPT khususnya pelaku usaha UMKM yang menerapkan skema Ekolabel TPT. / River water pollution caused by textile synthetic dye waste is very dangerous for the surrounding community. A way to prevent river water pollution is by applying ecolabel scheme on textile/textile, which encourages society, both textile entrepreneurs and textile consumers, to actively participate in river water conservation through sustainable consumption and production pattern. In this dissertation, the author analyzes the relevance of ecolabel scheme on textile/textile product in supporting the sustainable consumption and production scheme as the 12th Sustainable Development Goal (SDG), the implementation of regulation of ecolabel scheme on textile/textile product, and the strategy to regulate ecolabel scheme on textile/textile product in Indonesia that humanizes humans according to Indonesian volksgeist. This is a normative legal research, which is equipped with an empirical approach by examining secondary data and primary data. The secondary data consists of primary legal materials, secondary legal materials, tertiary legal materials, and non-legal materials. The primary data is obtained from questionnaires, focus group discussion (FGD) and an interview. This research uses statute approach, comparative approach, history approach and philosophy approach, and also uses the method of qualitative analysis and quantitative analysis. Based on the research result, ecolabel scheme on textile/textile product is relevant to support the sustainable consumption and production pattern because it is in line with international laws concerning sustainable development, Indonesian constitution and legislation concerning sustainable development, and spiritual and material aspect of Pancasila as stated in the First and Second Principle. The implementation of the regulations concerning ecolabel on textile/textile product in Indonesia has not been effective nor efficient, therefore a strategy is needed to regulate this ecolabel such as coordination between Ministry of Environment and Forestry and internal parties as well as external parties, and providing incentives to textile entrepreneurs especially to small and medium-sized entrepreneurs (SMEs), who are interested in applying the ecolabel on textile/textile product.
