Abstract

This research aims to find out the legal protection of consumers for live buying and selling on Facebook. The purpose of the second study is to find out the role of the Consumer Dispute Resolution Agency (BPSK) on consumers who buy goods live on Facebook. The research method used is empirical normative legal research. This research was conducted by reviewing the provisions of normative law, namely the Act on the Study of the Act as well as with the support of empirical data from online questionnaires. The way to get the data used is to use the method of literature study, which is a method of collecting data by conducting research on various literature such as books, papers, articles, and journals and online questionnaire. The result of the research in this thesis is that legal protection of consumers in live buying and selling transactions on Facebook is listed in the UUPK and ITE Act. UUPK in Article 4 writes the things that are the rights of consumers and Article 7 which describes consumer obligations. Article 62 of UUPK also regulates criminal sanctions against business actors who violate the provisions written in UUPK. Not only that the ITE Law in Article 5 also contains electronic document evidence as legal evidence at the trial, as well as Article 18 paragraph (1) and Article 28 paragraph (1) as a form of consumer protection. Not only that, BPSK in handling consumer disputes has provided litigation lines by filing a lawsuit through BPSK or with non-litigation channels such as mediation, negotiation, and so on in line with Law No. 30 of 1999 on Arbitration and Alternative Dispute Resolution. However, from the results of the questionnaire disseminated proved that many people do not know the existence of BPSK, so more socialization is needed so that the public knows more about BPSK. / Penelitian ini bertujuan, pertama untuk mengetahui perlindungan hukum terhadap konsumen dalam jual beli secara Live di Facebook. Tujuan penelitian kedua untuk mengetahui peran Badan Penyelesaian Sengketa Konsumen (BPSK) penyelesaian sengketa terhadap penyelesaian sengketa konsumen dalam jual beli secara Live di Facebook. Metode penelitian yang digunakan adalah penelitian hukum normatif empiris. Penelitian ini dilakukan dengan mengkaji ketentuan hukum normatif yaitu Undang-undang kajian terhadap Undang-undang serta dengan dukungan data empiris dari kuesioner online. Cara perolehan data yang dipakai ialah menggunakan metode studi kepustakaan, yaitu metode pengumpulan data dengan melakukan penelitian terhadap berbagai literatur seperti buku, makalah, artikel, dan jurnal serta kusioner online. Hasil penelitian dalam skripsi ini ialah perlindungan hukum terhadap konsumen dalam transaksi jual beli Live di Facebook tercantum dalam UUPK dan UU ITE. UUPK dalam Pasal 4 menuliskan hal-hal yang menjadi hak-hak konsumen serta Pasal 7 yang menjelaskan mengenai kewajiban konsumen. Pasal 62 UUPK juga mengatur sanksi pidana terhadap pelaku usaha yang melanggar ketentuan yang tertulis di UUPK. Tidak hanya itu UU ITE No.11 Tahun 2008 serta UU No.19 Tahun 2016,dalam Pasal 5 juga memuat mengenai alat bukti dokumen elektronik sebagai bukti legal di persidangan, serta Pasal 18 ayat (1) dan Pasal 28 ayat (1) sebagai bentuk perlindungan konsumen. Tidak hanya itu, BPSK dalam menangani sengketa konsumen telah meyediakan jalur litigasi dengan mengajukan gugatan melalui BPSK atau dengan jalur non-litigasi seperi mediasi, negosiasi, dan sebagainya yang sejalan dengan UU No. 30 Tahun 1999 tentang Arbitrase dan Alternatif Penyelesaian Sengketa. Namun, dari hasil kusioner yang disebar terbukti bahwa banyak masyarakat belum mengetahui adanya keberadaan BPSK, sehingga diperlukan sosialisasi lebih agar masyarakat lebih mengetahui tentang peran BPSK terhadap penyelesaian sengketa konsumen dalam jual beli secara Live di Facebook.
