Abstract

Penelitian ini memiliki tujuan untuk mengetahui pelaksanaan penumpang Lion Air sebagai Konsumen menurut Pasal 4 UU No. 8 Tahun 1999 tentenag Perlindungan Konsumen (UUPK). Tujuan penelitian kedua, mengetahui Perlindungan Hukum terhadap Konsumen yang Kehilangan Barang di Bagasi oleh PT Lion Mentari Airlines . Jenis penelitian yang dilakukan adalah penelitian hukum normatif empiris dengan tujuan mengkaji hukum dari beberapa aspek seperti teori, filosofi, perbandingan, struktur/komposisi, konsistensi, penjelasan umum dan penjelasan pada tiap pasal, formalitas sehingga dapat disimpulkan bahwa penelitian hukum normatif mempunyai cakupan yang luas dan berobjek pada doktrin, asas, prinsip hukum dalam penelitian ini didukung data Empiris. Jenis data yang digunakan adalah data primer yaitu melakukan wawancara mendukung data sekunder dengan teknik pengumpulan data library research sehingga mendapatkan kesimpulan dalam penelitian terkait perlindungan hukum bagi penumpang terkait bagasi. Hasil penelitian dalam skripsi ini kedudukan hukum penumpang Lion Air dapat dinyatakan sebagai Konsumen karena penumpang angkutan udara khususnya Lion air memenuhi syarat sebagai konsumen yaitu sebagai pengguna jasa akhir suatu jasa angkutan udara sehingga didalam hubungan hukum antara pengangkut atau maskapai penerbangan dengan penumpang UUPK juga mengikat sebagai landasan perolehan hak konsumen yang menjadi kewajiban maskapai penerbangan selaku pelaku usaha. Hasil penelitian kedua, perlindungan hukum terhadap Konsumen yang Kehilangan Bagasi oleh Jasa Angkutan Udara dapat diperoleh melalui UUPK dan peraturan perundang-undangan terkait penerbangan didalam UUPK pada Pasal 4 ayat (1) UUPK adalah hak atas kenyamanan, keamanan, dan keselamatan yang telah diakomodir oleh Lion air selain itu Pasal 2 huruf c Peraturan Menteri Perhubungan Nomor 77 Tahun 2011 bahwa pengangkut yang mengoperasikan pesawat wajib bertanggung jawab atas kerugian yang dialami penumpang berupa hilang dan/atau rusaknya barang bagasi tercatat selain itu Pasal 144 UU Penerbangan yang menyatakan jasa Pengangkut bertanggung jawab atas kerugian yang diderita oleh penumpang karena bagasi tercatat hilang, musnah, atau rusak yang diakibatkan oleh kegiatan angkutan udara selama bagasi tercatat berada dalam pengawasan pengangkut / This study aims to determine the implementation of Lion Air passengers as consumers according to Article 4 of Law no. 8 of 1999 concerning Consumer Protection (UUPK). The purpose of the second research is to find out the Legal Protection for Consumers who Lose Goods in the Baggage by PT Lion Mentari Airlines. The type of research carried out is empirical normative legal research with the aim of examining the law from several aspects such as theory, philosophy, comparison, structure/composition, consistency, general explanation and explanation of each article, formality so that it can be concluded that normative legal research has a broad scope and object of doctrine, principles, principles of law in this research is supported by empirical data. The type of data used is primary data, namely conducting interviews to support secondary data with library research data collection techniques so as to obtain conclusions in research related to legal protection for passengers related to baggage. The results of the research in this thesis, the legal position of Lion Air passengers can be declared as consumers because air transportation passengers, especially Lion Air, meet the requirements as consumers, namely as end users of an air transportation service so that in the legal relationship between the carrier or airline with passengers, UUPK is also binding as a basis. acquisition of consumer rights which are the obligations of airlines as business actors. The results of the second study, legal protection for Consumers who Lost Baggage by Air Transportation Services can be obtained through the UUPK and laws and regulations related to aviation in the UUPK in Article 4 paragraph (1) of the UUPK is the right to comfort, security, and safety that has been accommodated by Lion In addition, Article 2 letter c of the Regulation of the Minister of Transportation Number 77 of 2011 that the carrier operating the aircraft is obliged to be responsible for the loss suffered by the passenger in the form of lost and/or damaged checked baggage items in addition to Article 144 of the Aviation Law which states that the Carrier's services are responsible for the loss. suffered by passengers because their checked baggage is lost, destroyed, or damaged as a result of air transportation activities while the checked baggage is under the control of the carrier.
