Abstract
Perjudian menjadi tantangan aktual ataupun prospektif terhadap standar masyarakat sehingga bisa membahayakan tatanan sosial yang berkelanjutan. Seiring dengan pertumbuhannya, perjudian berbasis teknologi ataupun judi online berkembang serta berkembang seiring dengan meningkatnya jumlah pengguna alat komunikasi elektronik berbasis internet. Kepolisian bertanggung jawab dalam pencegahan serta pemberantasan tindak pidana perjudian online. Dalam penelitian ini, penulis akan menyelidiki upaya penegakan hukum perjudian online dengan memakai pendekatan analitis teori keadilan bermartabat. Rumusan masalah dalam penelitian ini, 1) Bagaimana kegiatan penegakan hukum terhadap perjudian online di Indonesia? 2) Bagaimana penegakan hukum perjudian online ditinjau dari Teori Keadilan yang Bermartabat? Penelitian ini dianalisis dengan menerapkan suatu bentuk pendekatan penelitian yuridis normatif. Penelitian yuridis normatif yakni penelitian yang memakai peraturan perundang-undangan serta berbagai literatur yang memakai data primer, data sekunder, serta data tersier. Temuan penelitian mengungkapkan bahwasanya tindakan penegakan hukum yang bisa dilakukan terhadap pelaku tindak pidana perjudian online meliputi operasi penegakan hukum preventif serta represif. Kegiatan preventif antara lain kerjasama dengan Kementerian Komunikasi serta Informatika guna melarang situs permainan judi online, kerjasama dengan negara lain dalam mengidentifikasi sumber judi online, patroli siber, serta sosialisasi kepada masyarakat guna menghindari tindak kriminal. Upaya represif dilakukan dengan melakukan tindakan tegas berupa penangkapan serta penjatuhan pidana terhadap pelaku tindak pidana perjudian online berdasarkan Pasal 27 ayat (2) jo. Pasal 45 ayat (2) UU ITE, serta Pasal 303 KUHP. Penegakan hukum perjudian online dalam pandangan teori keadilan yang bermartabat harus dilaksanakan dengan menjaga keadilan yang memanusiakan manusia. Cita-cita luhur ataupun volksgeist juga krusial dalam Teori Keadilan Bermartabat sehingga diperlukan upaya guna meningkatkan kesadaran kepada masyarakat tentang dampak ataupun risiko perjudian online. Saran yang bisa diberikan yakni perlunya pengadaan alat-alat canggih guna mendeteksi perjudian online serta kerjasama dengan Kepolisian di negara lain guna mencegah masuknya bandara baru ke Indonesia serta perlunya peningkatan kualitas serta pengetahuan penyidik dalam menangani kasus perjudian online./Gambling becomes a real or potential threat to social norms so that it can threaten the ongoing social order. Along with its development, technology-based gambling or online gambling grows and develops along with the increasing number of users of internet-based electronic communication tools. As a state apparatus carrying out law enforcement functions, maintaining security and public order as well as protecting, protecting and serving the community, the police are tasked with preventing and tackling the crime of online gambling. In this study, the author will examine the efforts of online gambling law enforcement using a dignified justice theory analysis knife. The formulation of the problem in this study, 1) How are law enforcement efforts against online gambling in Indonesia? 2) How is the law enforcement for online gambling in the perspective of the Theory of Dignified Justice? This research is examined by using a type of normative juridical research method. Normative juridical research is research that uses statutory regulations and various literatures that use primary data, secondary data, and tertiary data. The results of the study indicate that law enforcement efforts that can be carried out against perpetrators of online gambling crimes are preventive and repressive law enforcement efforts. Preventive efforts include cooperation with the Ministry of Communication and Informatics to block online gambling game sites, cooperation with other countries in tracking sources of online gambling, cyber patrols, and outreach to the public to prevent crime. Repressive efforts are carried out by taking decisive action in the form of arrests and imposing criminal sanctions on perpetrators of online gambling crimes based on Article 27 paragraph (2) jo. Article 45 paragraph (2) of the ITE Law, and Article 303 of the Criminal Code. Law enforcement of online gambling in the perspective of a dignified justice theory must be applied by upholding justice that humanizes humans. Noble values or volksgeist are also essential in the Theory of Dignified Justice so that efforts are needed to raise awareness to the public about the impact or danger of online gambling. Suggestions that can be given are the need for the procurement of sophisticated tools to detect activities related to online gambling as well as cooperating with the Police in other countries to prevent the entry of new airports into Indonesia and the need for improving the quality and knowledge of investigators in dealing with online gambling cases.
