Abstract

Praktek jual rugi merupakan bentuk persaingan usaha tidak sehat yang jarang terjadi di Indonesia, alasan yang mendasarinya karena praktek jual rugi sangat sulit dalam pembuktiannya. Dalam kasus PT Conch South Kalimantan Cement sebagai pelaku usaha di pasar semen Kalimantan Selatan sebagaimana dinyatakan dalam putusan Komisi Pengawas Persaingan Usaha (KPPU) yang dinyatakan telah melakukan praktek jual rugi berdasarkan alasan yang dapat merujuk pada bentuk persaingan usaha yang tidak sehat dalam kasus ini, perlu dikaji bentuk perlindungan hukum seperti apa yang dapat diberikan pemerintah bagi pelaku usaha pesaingnya untuk menjawab permasalahan ini, perlu dilakukan penelitian yuridis normatif yang dalam penelitian ini sebutkan bahwa KPPU tidak melakukan analisa secara mendalam dalam keputusannya. Selain itu, KPPU juga mengesampingkan hal-hal yang menjadi dasar PT Conch South Kalimantan Cement menjual semen dengan harga yang lebih rendah dibandingkan dengan pelaku usaha pesaingnya./ The practice of selling at a loss is a form of unfair business competition that rarely occurs in Indonesia, this is because the practice of selling at a loss is very difficult to find a bright spot in terms of proof. As is the case of PT Conch South Kalimantan Cement as a business actor in the South Kalimantan cement market as stated in the decision of the Business Competition Supervisory Commission which has been proven to have practiced selling at a loss based on considerations that take into account the elements of fulfilling the practice of selling at a loss. It is also necessary to pay attention to what forms of legal protection can be provided by the government for competing business actors. To answer the formulation of this problem, research was conducted using a theoretical normative juridical legal approach. In this case, it can be seen that the Business Competition Supervisory Commission have conducted a less in-depth analysis in making decisions and also ruled out the things that became the basis for PT Conch South Kalimantan Cement to be able to sell cement at a lower price than its competitors.
