Abstract

Berdasarkan publikasi data International Federation of the Phonographic Industry (IFPI) konsepsi Lisensi Sinkronisasi telah disegmentasi sebagai suatu bentuk pendapatan baru bagi industri musik global, yang perkembangannya cenderung meningkat sejak tahun 2010. Awalnya Lisensi Sinkronisasi ini hanya digunakan dalam industri film layar lebar. Namun, seiring dengan berkembangnya platform media sosial semacam YouTube, kebutuhan akan Lisensi Sinkronisasi atas lagu merambah secara luas ke pembuatan konten. Penelitian ini mengkaji dan menganalisa konsepsi dan implementasi Perjanjian Lisensi Sinkronisasi atas Hak Cipta Lagu dan atau Musik di Indonesia, dengan menggunakan metode penelitian yuridis normatif, meliputi pendekatan sejarah hukum dan pendekatan perbandingan hukum. Hasil Penelitian menemukan bahwa Lisensi Sinkronisasi atas Hak Cipta Lagu dan atau Musik diperlukan ketika seseorang ingin menggunakan Lagu dan atau Musik dalam suatu karya Sinematografi, terutama untuk film layar lebar, dokumenter, iklan video, musik video, konten media sosial atau bentuk-bentuk lainnya. Konsepsi Lisensi Sinkronisasi adalah instrumen yang digunakan sebagai dasar hukum bagi suatu pihak untuk menyinkronkan, menyelaraskan atau memadukan Lagu dan atau Musik dengan rekaman gambar visual untuk menjadi satu kesatuan ciptaan baru berbentuk audio-visual. Dalam pelaksanaannya, walaupun tidak secara khusus diatur di dalam Undang-Undang Hak Cipta Nomor 28 tahun 2014, nyatanya Konsepsi Lisensi Sinkronisasi ini bisa hadir, tumbuh dan diterima oleh masyarakat industri musik di Indonesia berdasarkan perjanjian/Based on the publication of the International Federation of the Phonographic Industry (IFPI) the concept of a Synchronization License has been segmented as a new form of income for the global music industry, whose development has tended to increase since 2010. Initially this Synchronization License was only used in the film industry and cinema. However, along with the development of social media platform such as YouTube, the need for a Synchronization License expanded widely to content creation. This study examines and analyze the conception and implementation of the Synchronization License Agreement for Copyright of Songs and or Music in Indonesia, using a normative juridical research method, including legal historical approach and comparative approach. The Research found that Synchronization License for Copyright of Songs and or Music is needed when a person wants to use Songs and or Music in a Cinematography work, especially for feature films, documentaries, video advertisements, music videos, social media content or any other forms. The Synchronization License Conception is an instrument that is used as legal bases for a party to synchronize, harmonize or combine Songs and or Music with a recording of visual images that filled in a new creation in the form of audio visual. In the implementation, although it is not specifically regulated in the Copyright Law Number 28 of 2014, in fact the Synchronization License can exist, grow, and accept by people in the music industry ecosystem in Indonesia based on agreement.
