Abstract

Warga negara menjadi unsur penting yang setara dengan unsur lainnya yaitu pemerintah dan wilayah. Warga negara harus mendapat jaminan perlindungan dan kepastian hukum atas hak dan kewajibannya yang turut melekat. Prinsip tersebut juga seyogyanya berlaku bagi anak-anak hasil perkawinan campuran antara Warga Negara Asing dengan Warga Negara Indonesia. Undang-Undang Nomor 12 Tahun 2006 tentang Kewarganegaraan Republik Indonesia telah mengatur kewarganegaraan secara komprehensif sebagai pengganti Undang-Undang Nomor 62 Tahun 1958 tentang Kewarganegaraan Republik Indonesia. Implementasi Undang-Undang Kewarganegaraan tersebut kemudian menimbulkan permasalahan yang tidak terakomodasi secara baik. Bagaimana peraturan hukum kewarganegaraan bagi anak hasil perkawinan campuran yang lahir sebelum ditetapkannya Undang-Undang Nomor 12 Tahun 2006 tentang Kewarganegaraan Republik Indonesia, serta bagaimana peran negara dalam memberikan perlindungan hukum terhadap anak-anak yang masuk kedalam kategori permasalahan tersebut. Penelitian ini menggunakan metode pengumpulan data melalui studi kepustakaan. Penelitian dilakukan dengan mengkaji peraturan perundang-undangan serta memverifikasi permasalahan kewarganegaraan pada Sub Direktorat Status Kewarganegaraan, Direktorat Jenderal Administrasi Hukum Umum, Kementerian Hukum dan HAM RI. Anak hasil perkawinan campuran akan diberikan status kewarganegaraan ganda secara terbatas. Anak tersebut harus menyatakan memilih salah satu kewarganegaraannya setelah berusia 18 (delapan belas) tahun dan harus disampaikan paling lambat 21 (dua puluh satu) tahun. Sebagai upaya memberikan kepastian hukum dan perlindungan hukum bagi anak-anak yang tidak didaftarkan kewarganegaraannya, saat ini sedang disusun Rancangan Peraturan Pemerintah (RPP) tentang Perubahan Peraturan Pemerintah Nomor 2 Tahun 2007 tentang Tata Cara Memperoleh, Kehilangan, Pembatalan, dan Memperoleh Kembali Kewarganegaraan Republik Indonesia/Citizens are an important element that is equal to other elements, namely the government and the region. Citizens must have guaranteed protection and legal certainty for their inherent rights and obligations. This principle should also apply to children resulting from mixed marriages between foreign citizens and Indonesian citizens. Law Number 12 of 2006 concerning Citizenship of the Republic of Indonesia has comprehensively regulated citizenship as a replacement for Law Number 62 of 1958 concerning Citizenship of the Republic of Indonesia. The implementation of the Citizenship Law then creates problems that are not properly accommodated. How is the legal regulation of citizenship for children from mixed marriages born before the enactment of Law Number 12 of 2006 concerning Citizenship of the Republic of Indonesia, and how is the role of the state in providing legal protection for children who fall into this category of problems. This research uses data collection method through literature study. The research was conducted by reviewing the legislation and verifying citizenship issues at the Sub-Directorate of Citizenship Status, Directorate General of General Legal Administration, Ministry of Law and Human Rights of the Republic of Indonesia. Children resulting from mixed marriages will be granted dual citizenship status on a limited basis. The child must declare choosing one of his nationalities after the age of 18 (eighteen) years and must be submitted no later than 21 (twenty one) years. In an effort to provide legal certainty and legal protection for children whose citizenship is not registered, a Draft Government Regulation (RPP) is currently being drafted on Amendment to Government Regulation Number 2 of 2007 concerning Procedures for Acquiring, Losing, Canceling, and Regaining Indonesian Citizenship
