Abstract

The purpose of the research conducted by the author on the misuse of residence permits by foreign nationals is to find out the factors causing the violation of the residence permit of foreign citizens and to find out the consequences. law against foreign nationals who violate the residence permit in Indonesia. This study uses a normative juridical method. The author examines through case studies and looks at the existing laws and regulations. In addition, the authors also collect data through legislation, books and interviews with legal experts or practitioners. As well as studying cases that mention misuse of residence permits by foreign nationals. After that, the research results will be described in sentences. The results of this study indicate that the factor of the occurrence of residence permits by foreign nationals is due to the lack of supervision carried out by the immigration authorities in addition to ignorance or ignorance of foreign citizens who are indifferent to the regulations that have been in effect. Then the legal consequences for foreign nationals who exceed the residence permit in Indonesia are that if the foreigner holds a residence permit whose validity period has expired and is still in the territory of Indonesia for less than 60 (sixty) days from the time limit of the residence permit, a fee is charged according to the provisions laws and regulations and if they do not pay, they will be subject to immigration administrative actions in the form of deportation and deterrence. It is necessary to improve services, improve the monitoring system for foreigners entering and leaving the territory of Indonesia and law enforcement in accordance with applicable laws, because the weakness and negligence of immigration officials triggers abuse of residence permits by tourists in Indonesia and is easily exploited by them for abuse of residence permits./ Tujuan dari penelitian yang dilakukan oleh penulis tentang penyalahgunaan izin tinggal oleh warga negara asing adalah untuk mengetahui faktor penyebab terjadinya pelanggaran izin tinggal warga negara asing dan untuk mengetahui akibat hukum terhadap warga negara asing yang melanggar izin tinggal di Indonesia. Penelitian ini menggunakan metode yuridis normatif. Penulis meneliti melalui studi kasus dan melihat peraturan perundang-undangan yang ada. Selain itu data juga dikumpulkan penulis melalui undang-undang, buku dan wawancara bersama para ahli atau praktisi hukum. Serta mempelajari kasus yang menyebutkan adanya penyalahgunaan izin tinggal oleh warga negara asing. Setelah itu, hasil penelitian akan dideskripsikan dengan kalimat. Hasil penelitian ini menunjukan bahwa faktor terjadinya izin tinggal oleh warga negara asing karena masih kurangnya pengawasan yang dilakukan oleh pihak imigrasi selain itu ketidaktahuan ataupun ketidakingintahuan dari warga negara asing yang acuh terhadap peraturan yang telah berlaku. Kemudian akibat hukum terhadap warga negara asing yang melampaui izin tinggal di Indonesia bahwa jika orang asing pemegang izin tinggal yang telah berakhir masa berlakunya dan masih berada dalam wilayah Indonesia kurang dari 60 (enam puluh) hari dari batas waktu izin tinggal dikenai biaya beban sesuai dengan ketentuan peraturan perundang- undangan dan jika tidak membayar maka akan dikenai tindakan administratif keimigrasian berupa deportasi dan penangkalan. Diperlukan peningkatan pelayanan, peningkatan sistem pengawasan terhadap orang asing yang masuk dan keluar wilayah Indonesia dan penegakan hukum sesuai dengan undang-undang yang berlaku, karena kelemahan dan kelalaian pejabat imigrasi memicu penyalahgunaan izin tinggal oleh wisatawan di Indonesia dan mudah dieksploitasi oleh mereka untuk penyalahgunaan izin tinggal.
