Abstract

Notary is an authorized public official in making authentic deed and possesses other rights. In running Notary position, Notary must be able to act professionally and in accordance towards notary’s office constitution and notary code of conduct. However in reality, there were appears gave false information in the notarial deed. The purpose of this research is to find Notary’s responsibility towards the deed in connection between false information from the appears and legal consequences towards the deed in terms of Verdict No : 238/K/Pid/2013. This study was done through a normative method using secondary data analyzed qualitatively. Notary could not be called responsible as the notary has acted carefully and in accordance towards notary’s office constitution and code of conduct. Legal consequences towards the notarial deed with respect to the false information are to be void by law, because the deed violated one of the requirements to agreement validation which is legitimate cause. False information is not a legitimate cause or contrary with the constitution. / Notaris adalah pejabat umum yang berwenang untuk membuat akta autentik dan memiliki kewenangan lainnya. Dalam menjalankan jabatannya, notaris harus dapat bersikap profesional dan bertindak sesuai dengan UndangUndang Jabatan Notaris serta Kode Etik Notaris. Namun pada kenyataannya terdapat penghadap yang memberikan keterangan palsu dalam Akta Notaris. Tujuan penelitian ini adalah untuk mengetahui tanggung jawab notaris terhadap akta sehubungan dengan adanya keterangan palsu dari para penghadap dan akibat hukum terhadap akta tersebut ditinjau dari Putusan Nomor : 238/K/Pid/2013. Penelitian ini dilakukan melalui metode normatif dengan menggunakan data sekunder yang dianalisis secara kualitatif. Notaris tidak dapat dimintakan pertanggungjawaban sepanjang Notaris tersebut telah bersikap cermat, teliti serta bertindak sesuai dengan ketentuan dalam peraturan perundang-undang khususnya Undang-Undang Jabatan Notaris dan Kode Etik Notaris. Akibat hukum terhadap akta notaris sehubungan dengan adanya keterangan palsu adalah menjadi batal demi hukum, karena akta tersebut telah melanggar ketentuan salah satu syarat sahnya perjanjian yaitu mengenai sebab yang halal. Dasar keterangan palsu merupakan sebab yang tidak halal atau bertentangan dengan ketentuan undang-undang.
