Abstract

Notary is general officials who has the authority to make an authentic deed and authority other as referred to in section 1 numbers 1 The constitution of the Republic of Indonesia no 2 year 2014 about Notary. As public official a notary forbidden to doubled post, one of them as members of parliament. Member of parliament is state official. Ban notary who double post as state official arranged in section 17 article (1) points d The constitution of the Republic of Indonesia no 2 year 2014 about Notary. The purpose of this research is to know legal status and responsibility on deed were made by notary before he/she becomes member of parliament. By using the method normative juridical so it can be concluded that A Notary who was appointed as a member of parliament did not have to quit as a notary, but is obliged to leave his/her duty as regulated in section 11 article (1) The Constitution of The Republic of Indonesia Number 2 year 2014 about Notary. A Notary who is leave of absence delegating his/her authority to the Substitute Notary. Both Notary and Substitute Notary have their responsibilities respectively as regulated in section 65 The Constitusion of The Republic of Indonesia Number 2 Year 2014. The Substitute Notary takes responsible to all deed that he/she creates when he/she conducting the Protocol from the Notary who is leaving the duty. So responsibility for deed made before notary become a member of parliament are on notary concerned. / Notaris merupakan pejabat umum yang memiliki kewenangan untuk membuat akta otentik dan kewenangan lainnya sebagaimana dimaksud dalam pasal 1 angka 1 Undang-Undang Republik Indonesia Nomor 2 Tahun 2014 Tentang Jabatan Notaris. Sebagai pejabat umum Notaris dilarang untuk merangkap jabatan, salah satunya sebagai anggota Dewan Perwakilan Rakyat. Jabatan anggota Dewan Perwakilan Rakyat termasuk sebagai jabatan sebagai pejabat negara. Larangan notaris merangkap jabatan sebagai pejabat negara diatur dalam Pasal 17 ayat (1) poin d Undang Undang Jabatan Notaris. Tujuan penelitian ini untuk mengetahui kedudukan hukum notaris yang diangkat sebagai anggota Dewan Perwakilan Rakyat dan pertanggungjawaban terhadap akta-akta yang dibuat sebelum notaris menjadi anggota Dewan Perwakilan Rakyat. Dengan menggunakan metode yuridis normatif maka dapat disimpulkan bahwa notaris yang diangkat sebagai anggota Dewan Perwakilan Rakyat tidak harus berhenti sebagai notaris, namun wajib mengambil cuti sebagaimana diatur dalam Pasal 11 ayat (1) Undang Undang Nomor 2 Tahun 2014. Notaris yang cuti melimpahkan kewenangan jabatannya kepada Notaris Pengganti. Baik Notaris dan Notaris Pengganti memiliki tanggung jawabnya masing-masing sesuai dengan ketentuan Pasal 65 Undang Undang Jabatan Notaris. Notaris Pengganti bertanggung jawab terhadap akta yang dibuatnya selama menjalankan Protokol Notaris yang sedang cuti. Sehingga pertanggungjawaban terhadap akta yang dibuat oleh Notaris sebelum diangkat menjadi anggota Dewan Perwakilan Rakyat dibebankan kepada Notaris yang bersangkutan.
