Abstract

Legislation has adopted the manufacture of Sale and Purchase Agreements (AJB) PPAT shall be made in accordance with the terms and conditions meteriil formal Deed manufacture. But in practice, they found AJB PPAT made without signed by the seller. It menraik to do research. The subject matter is bagaiamanakah legal settlement of the issuance of Certificate of Land Rights faulty administrative law for AJB is not signed Sales and how the legal protection for holders of Certificate of Land Rights faulty administrative law for AJB unsigned Seller. This type of research that is selected is a normative legal research with descriptive analytical research the nature and type of data used is secondary data. Results of the study were analyzed qualitatively for subsequent conclusions drawn deductively. The conclusion is AJB PPAT unsigned seller, is a material deviation from the requirements of a deed, which is due to the seller in the Deed made PPAT not accompanied by the consent of the parties has the right to approve a legal act in a deed. AJB PPAT unsigned seller and already issued certificate of land rights by the Land Office, any legal consequences certificate of land rights administration legal defects in its publication because of a mistake the subject of rights. The legal protection given to buyers with good intention which is at once the certificate holder the right to land, because in the transition of land rights through the sale and purchase of the suspected buyer does not know that in the end the certificate issued by the Land Office flawed administrative law. Forms of legal protection granted is the cancellation of the certificate to file a lawsuit to the Court of TUN, and / or apply for a cancellation of the certificate to the Land Office. / Peraturan perundang-undangan telah menetapkan ketentuan pembuatan Akta Jual Beli (AJB) PPAT harus dibuat sesuai dengan syarat meteriil dan syarat formil pembuatan Akta. Namun dalam praktek, masih ditemukan AJB PPAT yang dibuat tanpa ditandatangi penjual. Hal ini menraik untuk dilakukan penelitian. Pokok permasalahannya adalah bagaiamanakah penyelesaian hukum atas penerbitan Sertipikat Hak Atas Tanah yang cacad hukum administratif karena AJB yang tidak ditandatangani Penjual, dan bagaimana perlindungan hukum bagi pemegang Sertipikat Hak Atas Tanah yang cacad hukum administratif karena AJB yang tidak ditandatangani Penjual. Tipe penelitian yang dipilih adalah penelitian hukum normatif dengan sifat penelitian deskriptif analitis dan jenis data yang digunakan adalah data sekunder. Hasil penelitian dianalisis secara kualitatif untuk selanjutnya ditarik kesimpulan secara deduktif. Kesimpulannya adalah AJB PPAT yang tidak ditandatangani penjual, merupakan penyimpangan dari syarat materiil pembuatan akta, yaitu karena pihak penjual dalam Akta yang dibuat PPAT tidak disertai dengan adanya persetujuan dari pihak-pihak yang berhak memberi persetujuan terhadap perbuatan hukum dalam suatu akta. AJB PPAT yang tidak ditandatangani penjual dan terlanjur diterbitkan sertipikat hak atas tanah oleh Kantor Pertanahan, berakibat hukum sertipikat hak atas tanah cacat hukum administrasi dalam penerbitannya karena kesalahan subjek hak. Perlindungan hukum diberikan terhadap pembeli yang beritikad baik yang sekaligus adalah pemegang sertipikat hak atas tanah, karena dalam peralihan hak atas tanah melalui jual beli tersebut patut diduga pembeli tidak mengetahui bahwa pada akhirnya sertipikat yang diterbitkan oleh Kantor Pertanahan cacat hukum administrasi. Bentuk perlindungan hukum yang diberikan adalah pembatalan sertipikat dengan mengajukan gugatan ke Pengadilan TUN, dan/atau mengajukan permohonan pembatalan sertipikat kepada Kantor Pertanahan.
