Abstract

Penelitian ini ditujukan untuk mengkaji dan menganalisa perlindungan hukum bagi pemegang hak atas tanah berkaitan dengan sengketa sertipikat ganda dan menganalisa upaya hukum yang dapat dilakukan dalam penyelesaian sengketa sertipikat ganda. Penelitian ini menggunakan metode kualitatif dengan pendekatan hukum normatif emipiris. Adapun yang dimaksud dengan penelitian kualitatif yaitu penelitian yang bermaksud untuk memahami fenomena tentang apa yang dialami oleh subjek penelitian secara holistik, dan dengan cara deskripsi dalam bentuk kata-kata dan bahasa, pada suatu konteks khusus yang alamiah dan dengan memanfaatkan berbagai metode ilmiah. Sumber data yang dipergunakan dalam penelitian ini adalah sumber data primer dan sekunder. Cara perolehan data yang diambil adalah studi kepustakaan. Studi Kepustakaan adalah teknik pengumpulan data dengan melakukan studi pustaka terhadap bahan-bahan hukum, baik bahan hukum primer, bahan hukum sekunder, maupun bahan hukum tersier. Sertifikat hak atas tanah adalah suatu alat bukti yang kuat sebagaimana disebutkan secara eksplisit didalam Pasal 32 ayat (1) Peraturan Pemerintah Nomor 24 Tahun 1997 Tentang Pendaftaran Tanah. Hasil penelitian menunjukkan perlindungan hukum terhadap pemilik hak atas tanah dalam hal terdapat sertifikat ganda yaitu mendapatkan perlindungan hukum sebagaimana dalam Undang-Undang Republik Indonesia Nomor 5 Tahun 1960 tentang Peraturan Dasar Pokok-Pokok Agraria (UUPA) Pasal 19 ayat (2) huruf c, Pasal 23 ayat (2), Pasal 32 ayat (2) dan Pasal 38 ayat (2), dan Peraturan Pemerintah Nomor 24 Tahun 1997 Pasal 32 ayat (1), bahwa surat-surat tanda bukti hak berlaku sebagai alat pembuktian yang kuat. Penyelesaian sertipikat hak atas tanah ganda dilakukan dengan cara penyelesaian secara langsung oleh pihak dengan musyawarah, arbitrase dan alternatif penyelesaian sengketa dan penyelesaian sengketa melalui badan peradilan. Faktor- faktor yang menghambat dalam penyelesaian sertipikat hak atas tanah ganda antara lain kurangnya Mediator dalam Sengketa Tanah, pada Kantor Badan Pertanahan Nasional./This research aims at studying and analyzing legal protection of the land rights holders related to double certificate dispute, as well as analyzing legal effort that might be conducted to solve double certificate dispute. This research uses qualitative method with empirical normative legal approach. Furthermore, qualitative research means a research that is meant to understand a phenomena that is experienced by a research subject holistically and describing it in words and languages in a particular and natural context by utilizing various scientific methods. Data sources used in this research are primary and secondary data. Data obtaining technique used is library research. It is a data collection technique by conducting library research to legal materials, whether it is primary, secondary, or tertiary legal materials. Land rights certificate is one of the strong proofs as stipulated explicitly in Article 32 paragraph (1) Government Regulation Number 24 of 1997 concerning Land Registration. The result of the research shows that legal protection of the land rights holders in case there is a double certificate is to get legal protection as stipulated in the Law of the Republic of Indonesia Number 5 of 1960 concerning Basic Regulations on Agrarian Principles Article 19 paragraph (2) letter c, Article 23 paragraph (2), Article 32 paragraph (2), and Article 38 paragraph (2), and Government Regulation Number 24 of 1997 Article 32 paragraph (1), that valid proof documents as a strong evidence. Double certificate of the land rights completion is conducted by parties with direct settlements of deliberation, arbitration, alternative dispute resolution, and judicial dispute resolution. The inhibiting factor of the double certificate of the land rights completion is a lack of mediator in Land Dispute at Indonesian National Land Office.
