Abstract

Notary has the authority to make an authentic deed. The authentic deed gives legal certainty for citizen and has the power as a conclusive eveidence. In conducting his activity, Notary must work preciously, conscientiously, and inline with Notary’s Regulation and Code of Conduct. Notary’s liability in relation with the deed he produce is limited only to the formal truth that such deed is inline with the Notary’s Regulation, although in fact, Notary occasionally may be related to legal issue related with the material truth of his deed. Therefore, Notary is able to put the exemption clause in his deed to protect his interest from any civil claim. The issues in this research are regarding the binding force of an exemption clause of Notary’s liability put in authentic deed and the responsibility of Notary in relation with the addition of such clause. Therefore, the authors conducted this researched by using statute approach and normative legal research, based on data collected through literature study as a secondary data and supported by primary data, which is an interview with one of the Notary who put exemption clause in his deed. Based on this research, it can be concluded that the exemption clause of Notary’s liability is not prohibited to be included in a notarial deed and cannot be deemed as an abuse of Notary’s authority. Notary still carries the burden of liability regarding the formal truth of his deed, although he puts an exemption clause of Notary’s liability in his deed. / Notaris memiliki kewenangan untuk membuat akta otentik. Akta otentik tersebut merupakan akta yang dapat memberikan kepastian hukum bagi masyarakat dan memiliki kekuatan pembuktian yang sempurna. Dalam menjalankan jabatannya, Notaris harus cermat, teliti dan wajib tunduk pada ketentuan Undang-Undang Jabatan Notaris dan Kode Etik Notaris. Tanggung jawab Notaris terhadap akta yang dibuatnya sebatas pada kebenaran formil akta tersebut sesuai dengan ketentuan peraturan jabatan Notaris, namun tidak dapat dipungkiri bahwa Notaris dapat tersangkut masalah hukum terkait kebenaran materiil akta yang dibuatnya. Klausul pembebasan tanggung jawab Notaris dapat dicantumkan sebagai upaya proteksi agar terhindar dari tuntutan atau gugatan tersebut. Permasalahan dalam penelitian ini adalah bagaimana kekuatan hukum klausul pembebasan tanggung jawab Notaris dalam akta otentik yang dibuatnya serta mengetahui tanggung jawab Notaris terhadap akta tersebut.Oleh sebab itu, penulis melakukan penelitian hukum ini dengan melakukan pendekatan undang-undang dan penelitian yuridis normatif dan mengambil data dengan cara studi kepustakaan sebagai data sekunder dan di dukung dengan data primer yaitu wawancara dengan salah satu Notaris yang mencantumkan klausul pembebasan tanggung jawab pada aktanya.Dari hasil penelitian tersebut, dapat disimpulkan bahwa klausul pembebasan tanggung jawab Notaris tidak dilarang untuk dicantumkan dalam akta Notaris dan bukan merupakan penyalahgunaan kewenangan Notaris. Tanggung jawab terhadap kebenaran formil atas akta yang dibuatnya tetap melekat pada Notaris walaupun dalam aktanya tercantum klausul pembebasan tanggung jawab.
