Abstract

Hak Asasi Manusia adalah Hak yang melekat pada hakikat keberadaan manusia sebagai mahluk ciptaan Tuhan Yang Maha Esa, dan merupakan anugrah yang wajib untuk dihormati, dijunjung tinggi, dan dilindungi oleh Negara, Hukum, Pemerintah, dan setiap Orang demi kehormataan serta perlindungan harkat dan martabat manusia. Pelanggaran Hak Asasi Manusia adalah setiap perubahan seseorang atau kelompok orang termasuk aparat negara itu sendiri. Test Keperawanan merupakan salah satu bentuk diskriminasi yang tidak adil bagi kaum wanita karena ada beberapa instansi yang menggunakan “Test Keperawanan” ini sebagai salah satu patokan diterima atau tidaknya seorang wanita untuk masuk kedalam instansi tersebut dan hal itu melanggar aturan Undang-Undang pasal 10, 12, dan 21 Undang-Undang no. 39 tahun 1999 tentang Hak Asasi Manusia. Metode penelitian yang digunakan dalam penelitian ini adalah penelitian yuridis normatif yaitu penelitian yang dilakukan dengan studi pustaka, yang mengacu pada bahan-bahan hukum baik itu bahan hukum primer dan bahan hukum sekunder yang berkaitan dengan penelitian ini. Dari hasil penelitian disimpulkan bahwa Test Keperawanan merupakan bentuk dari diskriminasi dan ketidakadilan yang terjadi dan test keperawanan tersebut harus segera dihentikan karena tidak dapat dibuktikan secara ilmiah ke akuratan-nya / Human Rights are rights inherent in the nature of human existence as creatures created by God, and are gifts that are obliged to be respected, highly respected, and protected by the State, Law, Government, and Everyone for the sake of respect and protection of human dignity. Human Rights Violations are any changes in a person or group of people including the state apparatus itself. “Virginity Test” is one form of unfair discrimination for women because there are several agencies that use the "Virginity Test" as one of the standards for whether a woman is accepted or not to enter the agency and it violates the provisions of Laws Articles 10, 12, and 21 of Law no. 39 of 1999 concerning of Human Rights. The research method used in this study is normative juridical research that is research conducted with literature study, which refers to legal materials both primary and secondary legal materials related to this research. From the results of the study concluded that the Virginity Test is a form of discrimination and injustice that occurs and the virginity test must be stopped immediately because it cannot be proven scientifically to its accuracy.
