Abstract

Merek merupakan suatu tanda yang memiliki peranan penting dalam dunia perdagangan sebagai pembeda antara suatu produk dengan produk lainnya. Aturan mengenai perlindungan Merek di Indonesia diatur dalam UU No 20/2016. Ketentuan UU No 20/2016 mengatur mengenai merek yang tidak dapat didaftarkan atau merek yang ditolak permohonannya, salah-satunya disebabkan karena menyerupai nama orang terkenal. Kasus yang penulis angkat dalam skripsi ini adalah gugatan merek Bensu oleh Ruben Onsu terhadap Jessy Handalim yang telah dahulu mendaftarkan merek Bensu pada tahun 2015 untuk kelas 43 makanan dan minuman. Metode yang digunakan dalam penelitian ini adalah yuridis normatif dengan menggunakan logika berpikir secara deduktif, yakni berangkat dari hal-hal yang bersifat umum untuk sampai kepada kesimpulan yang bersifat khusus. Penelitian ini bertujuan untuk mengkaji mengenai perlindungan merek di Indonesia yang menggunakan system first to file serta untuk memahami secara detail mengenai alasan penolakan atau dapat dibatalkannya suatu merek. Adapun kesimpulan dari skripsi ini adalah Jessy Handalim tidak melanggar UU No 20/2016, sehingga dapat dikatan dia adalah pemilik merek Bensu yang sah / Trademark is an important aspect in the trading industry. It is the key differentiator between one product and another.Indonesia’s UU No 20/2016 regulates brand protection such that there are several points that cause a brand registration to be denied, one of them is because a certain brand name is similar to a popular person’s name.The case that the writer brings up in this essay is a lawsuit by Ruben Onsu against Jessy Handalim regarding the brand Bensu. Jessy Handralim registered the brand Bensu under the class 43 food & beverage in 2015. The method used in this research is juridical normative using deductive logic, in which the writer formulates the overview to finally reach a specific conclusion.The goal of this research is to understand deeper about Indonesia’s brand protection law that uses a first-to-file system. Another goal is to understand in detail about the reason why a certain brand registration is declined or cancelled.The conclusion of this essay is that Jessy Handalim did not violate UU No 20/2016 so she is the legal owner of the brand Bensu
