Abstract

Kejahatan-kejahatan terorganisir secara terstruktur, sistematis, dan masif telah mengalami perkembangan yang cukup pesat seiring dengan perkembangan ekonomi dunia. Dalam kaitannya dengan penegakkan keadilan berdasarkan hukum, maka diperlukan pemahaman yang lebih mendalam khususnya peraturan perundang-undangan yang mengatur tentang kejahatan-kejahatan terorganisir. Selain itu pemahaman terhadap asas-asas yang berlaku dalam peraturan perundang-undangan terkait juga diperlukan. Secara logis kejahatan-kejahatan terorganisir dilakukan orang-orang yang tergabung dalam kesatuan organisasi baik yang telah mendapatkan pengesahan dari negara melalui menteri-menteri terkait maupun belum mendapatkan pengesahan. Yang dalam hal ini dapat disebut sebagai korporasi. Dimana pengertian korporasi dalam peraturan perundangundangan serta asas-asas yang berlaku perlu dicari tahu kebenarannya agar dalam penegakkan keadilan berdasarkan hukum memberikan kepastian hukum bagi pelaku kejahatan-kejahatan terorganisir tersebut / Structured, systematic and massive organized crimes have experienced rapid development along with the development of the world economy. In relation to the enforcement of justice based on the law, a deeper understanding is needed in particular the laws and regulations governing organized crime. In addition, an understanding of the principles applicable in the relevant laws and regulations is also required. Logically organized crimes are committed by people who are members of a unitary organization that has been approved by the state through the relevant ministers or not yet approved. Which in this case can be called a corporation. Where is the understanding of the corporation in the laws and regulations as well as the principles that apply, it is necessary to find out the truth so that in upholding justice based on the law provides legal certainty for the perpetrators of organized crime
