Abstract

Penelitian ini membahas tentang harusnya memiliki kartu BPJS yang aktif sebagai salah satu syarat dalam jual beli tanah. Mulai tanggal 1 Maret 2022, peralihan hak atas tanah akibat adanya jual beli tanah harus dilengkapi dengan fotokopi kartu BPJS Kesehatan. Kepemilikan kartu BPJS dan kepesertaan yang aktif menjadi syarat dalam jual beli tanah sesuai dengan Surat Dirjen PHPT No.HR.02/153-400/II/2022 juncto INPRES Republik Indonesia Nomor 1 Tahun 2022 tentang Optimalisasi Program Pelaksanaan Jaminan Kesehatan Nasional. Peraturan ini tentunya berdampak terhadap hak asasi manusia, dimana masyarakat yang ingin melakukan perjanjian jual beli tanah dipaksa untuk mengikuti syarat tambahan ini. Metode yang digunakan dalam penelitian ini adalah yuridis normatif dan diperoleh dari studi kepustakaan bahan hukum yang ada. Berdasarkan hal tersebut, tujuan dari penelitian ini adalah untuk mengetahui kepemilikan Kartu BPJS Kesehatan sebagai salah satu syarat dalam perspektif HAM, dan hasil dari analisis penelitian ini adalah tidak adanya korelasi antara kepemilikan kartu BPJS Kesehatan dengan jual beli tanah./This study discusses the necessity of having an active BPJS card as one of the requirements in buying and selling land. Starting March 1, 2022, the transfer of land rights due to the sale and purchase of land must be accompanied by a photocopy of the BPJS Health card. Ownership of a BPJS card and active membership is a requirement in buying and selling land in accordance with Letter of the Director General of PHPT No. HR.02/153- 400/II/2022 juncto INPRES of the Republic of Indonesia No. 1 of 2022 concerning Optimizing the Implementation of the National Health Insurance Program. This regulation certainly has an impact on human rights, where people who want to enter into a land sale and purchase agreement are forced to follow this additional requirement. The method used in this research is juridical normative and obtained from a literature study of existing legal materials. Based on this, the purpose of this study was to determine the ownership of the BPJS Health Card as one of the requirements in the perspective of human rights, and the results of the analysis of this study were that there was no correlation between the ownership of the BPJS Health card and the sale and purchase of land.
