Abstract

Bullying is a form of aggressive behaviour in which someone intentionally and repeatedly causes another person injury or discomfort. As technology has advanced, bullying spreads into the technological realm. Cyberbullying is when individuals are utilizing technology, such as smartphone and the internet, to repeatedly and intentionally harass, hurt, humiliate, or intimidate others with the intention of causing harm. The development and propagation of omnipresent social media platforms, internet and digital technologies expanded the possibility for cyberbullying. The main objective of this qualitative research is to identify the psychological and sociological factors that lead someone to engage in cyberbullying from criminological perspective. The primary data of this research were collected through interviews, and the secondary data were collected through library researches. In analyzing this research data, researcher uisng inductive methods. The results of this research showed that: (1) Psychological factor play a dominant role in the occurrence of cyberbullying such as feelings of hatred, offense or disappointment, (2) Sociological theories and studies indicate family and social environment greatly influence one’s behavior, (3) Heretofore there are only two legal products that can be used to deal with cyberbullying, viz. the Criminal Code (KUHP) and the ITE Law. However, these two legal products are not effective in overcoming cyberbullying, moreover there are still many articles in the ITE Law that are opaque and require specific guidelines to provide clear boundaries and contexts regarding ambiguous articles.
