Abstract

Penelitian ini membahas tentang pengurungan manusia dalam kerangkeng pada rumah hunian yang dilakukan oleh Bupati Langkat. Diketahui bahwa kerangkeng tersebut digunakan sebagai tempat rehabilitasi para pecandu narkoba dan kenakalan remaja, namun kenyataannya mereka yang ada dalam kerangkeng manusia ini justru dipekerjakan di kebun kelapa sawit milik Bupati Langkat. Terkait kerangkeng manusia tindakan tersebut telah melanggar HAM. Penelitian ini menggunakan metode penelitian yuridis normatif – dogmatik. Melalui pendekatan masalah Statue Approach (pendekatan melalui perundang-undangan) dan Conceptual Approach (pendekatan konseptual). Dalam hasil penelitian ini, dapat disimpulkan bahwa tindakan Bupati Langkat yang mengurung manusia didalam kerangkeng ini merupakan pelanggaran terhadap HAM yang tertuang pada Pasal 4, 14 ayat (1), 17, 20 ayat (1), 25, 30, 38 ayat (4), 58, 61, serta 64 Undang-Undang Nomor 39 Tahun 1999 tentang Hak Asasi Manusia. / This study discusses the confinement of humans in cages in residential homes carried out by the Regent of Langkat. It is known that these cages are used as a rehabilitation center for drug addicts and juvenile delinquents, but in reality those in these human cages are actually employed in the oil palm plantation owned by the Langkat Regent. Regarding the human cage, these actions have violated human rights. This study uses a normative - dogmatic juridical research method. Through the problem approach Statue Approach (approach through legislation) and Conceptual Approach (conceptual approach). In the results of this study, it can be concluded that the action of the Regent of Langkat in confining humans in this cage is a violation of human rights as stated in Article 4, 14 paragraph (1), 17, 20 paragraph (1), 25, 30, 38 paragraph (4), 58, 61, and 64 of Law Number 39 of 1999 concerning Human Rights.
