Abstract

Penelitian ini membahas tentang perlindungan hukum terhadap anak yang ditelantarkan oleh orang tua kandung setelah perceraian. Peran orang tua dalam perlindungan dan pemenuhan hak anak ini sangat penting. Namun saat ini masih banyak kejadian pelanggaran hak anak yang diakibatkan oleh perceraian. Dalam penelitian ini mengangkat kasus penelantaran anak oleh atlit pesepakbola Indonesia Bambang Pamungkas. Perlindungan terhadap anak telah diatur dalam hukum positif di Indonesia, secara khusus diatur dalam Undang-Undang Nomor 23 Tahun 2002 kemudian di revisi menjadi Undang-Undang Nomor 35 Tahun 2014 tentang Perlindungan anak. Tugas akhir ini bertujuan untuk mengetahui perlindungan hukum pada anak yang ditelantarkan orang tua. Penelitian ini menggunakan metode Yuridis-Normatif, serta pendekatan secara konseptual dan perundang-undangan. Hasil analisis tugas akhir ini menunjukan, bahwa sebagai orang tua harus bertanggung jawab atas hak dan perlindungan anak terlebih saat terjadinya perpisahan akibat perceraian. Melalui pembahasan tugas akhir ini dapat disimpulkan bahwa Bambang Pamungkas mempunyai kewajiban dan tanggung jawab terhadap kedua anak dari mantan istrinya Amalia Fujiawati. Tindakan Bambang Pamungkas yang telah melanggar kewajiban dan tanggung jawabnya dapat dipidana dan denda sesuai dengan ketentuan pada Undang-Undang Nomor 23 Tahun 2002 jo Undang-Undang Nomor 35 Tahun 2014 tentang Perlindungan Anak. / This research discusses about the legal protection of neglected children by biological parents after divorce. The role of parents in the protection and fulfillment of children's rights is very important. However, currently there are still many incidents of violations of children's rights caused by divorce. In this research, it raised the case of child neglect by Indonesian football athlete Bambang Pamungkas. Protection of children has been regulated in Indonesia positive law, specifically regulated in Law Number 23/2002 then revised to Law Number 35/2014 about Child Protection. This final project aims to find out legal protection on children neglected by parents. This research uses the Juridical-Normative method, as well as conceptual approaches and statutes approaches. The results of this final project analysis show that as parents must be responsible for the rights and protection of children, especially during separation due to divorce. Through the discussion of this final project, it can be concluded that Bambang Pamungkas has the obligations and responsibilities for the two children of his ex-wife Amalia Fujiawati. Bambang Pamungkas actions that have violated his obligations and responsibilities can be punished and fined in accordance with the provisions of Law Number 23/2002 jo Law Number 35/2014 about Child Protection.
