Abstract

Pembatalan Penetapan Anak Sah pada dasarnya dapat diartikan sebagai pencabutan putusan yang telah ada sebelumnya mengenai pengesahan anak luar kawin oleh Mahkamah Agung dengan alasan-alasan tertentu. Pembatalan penetapan anak sah harus sesuai dengan hukum positif yang berlaku di Indonesia dan tidak dapat dilakukan bila tidak memenuhi persyaratan sebagaimana diatur dalam Undang – Undang No. 5 Tahun 2004 Tentang Perubahan Atas Undang- Undang No. 14 Tahun 1985 Tentang Mahkamah Agung. Tugas akhir ini bertujuan untuk mengetahui kebenaran atas pembatalan penetapan anak sah beserta persyaratan-persyaratannya yang harus dipenuhi dalam mengajukan pembatalan penetapan. Hasil analisis dalam tugas akhir ini menunjukkan bahwa pembatalan penetapan anak sah Freddy Widjadja oleh Mahkamah Agung tidak beralasan hukum cukup kuat. Melalui pembahasan tugas akhir ini dapat disimpulkan bahwa penegak hukum dalam kasus pembatalan penetapan anak sah Freddy Widjadja tidak berlandaskan pada hukum positif yang berlaku serta menyimpang dari Undang – Undang No. 5 Tahun 2004 Tentang Perubahan Atas Undang-Undang No. 14 Tahun 1985 Tentang Mahkamah Agung / The cancellation of the determination of legitimate children can be interpreted as the revocation of a pre-existing decision regarding the legitimation of a child out of wedlock by the Supreme Court for certain reasons. The cancellation has to be in accordance with positive law applicable in Indonesia and cannot be carried out if it does not meet the requirements as regulated in Law No. 5 of 2004 concerning Amendments to Law No. 14 of 1985 concerning the Supreme Court. This final project aims to identify the truth of the cancellation of the determination of a legitimate child and the requirements in applying for the cancellation. The results of the analysis showed that the cancellation of the legitimate child of Freddy Widjadja by the Supreme Court had no strong legal grounds. It can be concluded that law enforcement in the case of the cancellation of the determination of the legitimate child of Freddy Widjadja is not based on the applicable positive law and deviates from Law No. 5 of 2004 concerning Amendments to Law No. 14 of 1985 concerning the Supreme Court.
