Abstract

Nikel merupakan salah satu kekayaan tambang yang saat ini sedang dilirik dan diminati oleh para investor asing seluruh dunia. Pengesahan Undang-Undang Nomor 3 Tahun 2020 Tentang Perubahan Undang-Undang Republik Indonesia Nomor 4 Tahun 2009 tentang Pertambangan Mineral dan Batubara telah menuai polemik di masyarakat pertambangan. Salah satu ketentuan yang menjadi polemik dan menjadi stigma negatif adalah ketentuan mengenai dihapusnya kewenangan pemerintah daerah, baik provinsi dan kabupaten/kota, dalam menyelenggarakan pengelolaan pertambangan mineral dan batubara. Pemerintah pusat berdasarkan amanat dari Undang-Undang No. 3 Tahun 2020 telah mengambil alih kewenangan dari pemerintah daerah sehingga yang berwenang adalah Kementerian Energi dan Sumber Daya Mineral sesuai dengan peran dan kedudukan untuk mengelola perizinan mineral dan batubara pada tingkat nasional. Penelitian ini terdapat dua rumusan masalah. Rumusan masalah yang pertama adalah bagaimanakah pengaturan perizinan di bidang pertambangan bijih nikel dan rumusan masalah yang kedua adalah bagaimanakah implementasi peralihan perizinan berusaha dalam bidang pertambangan bijih nikel. Penelitian ini akan menggunakan metode penelitian hukum normatif dan metode penelitian hukum normatif-empiris dengan pendekatan terhadap asas-asas hukum dan pendekatan terhadap sinkronisasi hukum baik secara vertikal maupun horizontal. Peralihan perizinan berusaha dalam bidang pertambangan bijih nikel diharapkan menjadi jawaban atas carut marutnya birokrasi perizinan di Indonesia, akan tetapi pada implementasinya masih terdapat permasalahan-permasalahan dan hambatan-hambatan yang perlu dihadapi oleh pemerintah pusat, pemerintah daerah dan para pelaku usaha pertambangan / Nickel is one of mining wealth that is being noticed and interested by foreign investors from all over the world. The enactment of Law Number 3 Year 2020 Regarding Amendment of Law Number 4 Year 2009 Regarding Coal and Mineral Mining had caused polemic in mining communities. One of the provision that becomes a polemic and negative stigma is the provision regarding the eradication of local government, either provincial or regency/city, in carrying out coal and mineral mining management. Central government based on the mandate from Law No. 3 Year 2020 has taken over the authority from local government therefore the Ministry of Energy and Mineral Resources based on its role and position to manage the permit of coal and mineral on the national level. This research has two problem formulations. The formulation of the first problem is how to regulate licensing in the field of nickel ore mining and the formulation of the second problem is how to implement the transfer of business permit in the field of nickel ore mining. This research use normative legal research methods and normative-empirical legal research methods with the approach to legal principles and to legal synchronization both vertically and horizontally. The transfer of business licensing in the field of nickel ore mining is expected to be the answer to the rampant licensing bureaucracy in Indonesia, but in its implementation there are still problems and obstacles that need to be faced by the central government, local governments and mining business actors.
