Abstract

Tourism is one of the leading sectors which is the focus of the development of Bali government. The implementation of Balinese cultural tourism continues to be encouraged by the local government by maximizing the potential of Daya Tarik Wisata (DTW) spread across Bali. DTW management is carried out by the regional government and customary villages that are the owners of the DTW concerned. One of the DTWs managed by the regional government and the customary village is Pura Tirta Empul which is located at the Manukaya Let customary village, Tampaksiring, Gianyar. The management of DTW Pura Tirta Empul was carried out based on a cooperation agreement among the Head of the Gianyar Regency Tourism Department and the Headman of Manukaya Let customary village. The cooperation agreement regulates the profit sharing of DTW Pura Tirta Empul entrances ticket for the regional government of Gianyar regency and Manukaya Let customary village. The position between the regional government is higher compared to customary villages to create practices of agreements that are not in accordance with the principles in the Regional Regulation of the Province of Bali related to the implementation of tourism. Therefore, this thesis will analyze the practice of agreements based on the law of agreement and the Regional Regulation of the Province of Bali. In addition, this thesis will also analyze the protection of indigenous peoples obtained after being bound by the cooperation agreement. This thesis uses normative-empirical research and takes a conceptual law. The material used as a reference in this thesis included interviews conducted by the Headman of the Manukaya Let customary village, Head of Gianyar Regency Tourism Department, also Professor of Balinese customary law, and legal analysis. Through the sources mentioned above, this thesis can conclude that the practice of cooperation agreements between local governments and customary villages still needs to be improved, and prevention tips are needed that DTW management can run as the purpose of implementing Balinese cultural tourism.
