Abstract

Negara Republik Indonesia sebagai negara hukum berdasarkan Pancasila dan Undang-Undang Dasar Negara Republik Indonesia Tahun 1945 menjamin kepastian hukum. Tanah mempunyai peranan besar dalam dinamika pembangunan, salah satu upaya yang dilakukan negara untuk memenuhi tujuan meningkatkan kesejahteraan umum sesuai UUD 1945 khususnya dalam bidang pertanahan adalah dengan mengeluarkan Undang-undang Pokok Agraria atau yang biasa disebut dengan UUPA. Girik merupakan bukti pembayaran pajak, bukan sebagai bukti kepemilikan hak Atas tanah, bukti kepemilikan hak atas tanah menurut UUPA adalah sertifikat tanah. Penelitian yang dilakukan ini merupakan bentuk penelitian normatif. Yang dimaksud dengan penelitian tipe normatif berarti dalam penelitian ini selain meneliti mengenai isi perundang-undangan itu sendiri juga menemukan kebenaran berdasarkan logika keilmuan dari sisi normatifnya. Kepastian diartikan suatu kejelasan norma sehingga hal itu dapat dijadikan pedoman atau panduan bagi kalangan masyarakat yang dikenakan peraturan ini. Girik yang ingin mempunyai kepastian hukum harus didaftarkan terlebih dahulu dan menjadi Sertipikat tanah. Tujuan pendaftaran tanah yang diselenggarakan adalah dalam rangka memberikan jaminan kepastian hukum di bidang pertanahan./The Republic of Indonesia as a legal state based on Pancasila and the 1945 Constitution of the Republic of Indonesia guarantees legal certainty. Land has a big role in the dynamics of development, one of the efforts made by the state to fulfill the goal of increasing general welfare in accordance with the 1945 Constitution, especially in the field of land is by issuing the Basic Agrarian Law or what is commonly referred to as the UUPA. Girik is proof of payment of taxes, not as proof of ownership of land rights. Proof of ownership of land rights according to the UUPA is a land certificate. This research is a form of normative research. What is meant by normative type research means that in this research apart from examining the contents of the legislation itself it also finds the truth based on scientific logic from the normative side. Certainty is defined as a clear norm so that it can be used as a guideline or guidance for the community that is subject to this regulation. Girik who wish to have legal certainty must be registered first and become a land certificate. The purpose of land registration being held is to provide guarantees of legal certainty in the land sector.
