Abstract

Bandar Udara Internasional Soekarno Hatta merupakan salah satu pintu masuk lalu lintas keluar masuk barang dari dan ke luar negeri yang tidak menutup kemungkinan dijadikan sebagai sarana untuk melakukan tindak kejahatan penyelundupan narkotika. Penelitian ini bertujuan untuk menganalisis pengaturan penegakan hukum pada Direktorat Jenderal Bea dan Cukai dalam memberantas penyelundupan narkotika melalui jalur udara, dan menganalisis implementasi penegakan hukum pada Direktorat Bea dan Cukai dalam memberantas penyelundupan narkotika melalui Bandara Internasional Soekarno-Hatta. Penelitian ini menggunakan jenis penelitian normatif dengan pendekatan undang-undang dan konseptual. Bahan hukum yang digunakan bersumber dari bahan hukum primer dan sekunder dengan teknik kepustakaan yang dianalisis secara kualitatif. Berdasarkan hasil penelitian penulis, bahwa pengaturan penegakan hukum pada Direktorat Jenderal Bea dan Cukai dalam memberantas penyelundupan narkotika melalui jalur udara secara substansi diatur dalam KUHAP, UU Kepabeanan, UU Narkotika, dan peraturan pemerintah sebagai pengaturan pelaksanaannya, dimana PPNS Direktorat Jenderal Bea dan Cukai dalam melakukan penyidikan terhadap penyelundupan narkotika berkoordinasi dengan penyidik Polri atau BNN yang dilaksanakan menurut hukum acara pidana. Implementasi penegakan hukum dalam memberantas penyelundupan narkotika melalui Bandar Udara Internasional Soekarno-Hatta, Direktorat Jenderal Bea dan Cukai hanya dapat melakukan perbantuan dalam penyerahan yang diawasi (controlled delivery) berdasarkan permintaan dari BNN atau Polri yang diatur dalam Pasal 140 ayat (2) jo Pasal 81 Per-17/BC/2020. Controlled delivery ini dapat dilakukan dalam hal penindakan terkait narkotika ditemukan adanya dugaan tindak pidana narkotika di luar kewenangan PPNS Direktorat Jenderal Bea dan Cukai sebagaimana Pasal 81 ayat (2) Per-17/BC/2020. Kata kunci: Peran, Direktorat Jenderal Bea Dan Cukai, Penyelundupan Narkotika./ Soekarno Hatta International Airport is one of the entry points for traffic in and out of goods to and from abroad which does not rule out being used as a means for committing crimes of narcotics smuggling. This study aims to analyze law enforcement arrangements at the Directorate General of Customs and Excise in eradicating narcotics smuggling through the airways, and to analyze the implementation of law enforcement at the Directorate of Customs and Excise in eradicating narcotics smuggling through Soekarno-Hatta International Airport. This study uses a type of normative research with a statutory and conceptual approach. The legal materials used are sourced from primary and secondary legal materials with literary techniques which are analyzed qualitatively. Based on the results of the author's research, that law enforcement arrangements at the Directorate General of Customs and Excise in eradicating narcotics smuggling through th airways are substantially regulated in the Criminal Procedure Code, the Customs Law, the Narcotics Law, and government regulations as implementing regulations, where PNS Investigators of the Directorate General of Customs and Excise in carrying out investigations into narcotics smuggling, coordination with investigators from BNN or the National Police is carried out according to the criminal procedure law. Implementation of law enforcement in eradicating narcotics smuggling through Soekarno-Hatta International Airport, Directorate General of Customs and Excise can only provide assistance in controlled delivery based on requests from the National Police or BNN regulated in Article 140 paragraph (2) jo Article 81 Per-17/BC/2020. This controlled delivery can be carried out in the event that prosecutions related to narcotics are found to have alleged narcotic crimes outside the authority of the PPNS Directorate General of Customs and Excise as stated in Article 81 paragraph (2) Per-17/BC/2020.
