Abstract

Untuk meminimalisir risiko kredit, kreditur melakukan pengikatan jaminan dengan dibebani hak tanggungan. Apabila debitur cidera janji, kreditur dapat melakukan penjualan jaminan melalui lelang. Debitur/pemberi hak tanggungan dapat mengajukan pembatalan lelang ke pengadilan. Penelitian ini, menelaah bagaimana eksistensi/kedudukan akta perjanjian kredit dan akta pemberian hak tanggungan setelah adanya putusan pengadilan yang membatalkan lelang jaminan hak tanggungan dan bagaimana isi putusan pengadilan jika terdapat gugatan yang menuntut pembatalan lelang hak tanggungan dikaitkan dengan akta perjanjian kredit dan akta pemberian hak tanggungan. Dalam penelitian ini pengumpulan data dilakukan dengan menggunakan pendekatan peraturan perundang-undangan dan juga pendekatan kasus, dengan mewawancarai bank dan hakim sebagai nara sumber untuk menjawab permasalahan di atas. Hasil penelitian disimpulkan, bahwa akta perjanjian kredit dan akta pemberian hak tanggungan secara hukum mengikat kembali kepada para pihak setelah adanya putusan pengadilan yang membatalkan lelang hak tanggungan dan isi putusan pengadilan mengenai pembatalan lelang hak tanggungan dikaitkan dengan akta perjanjian kredit dan akta pemberian hak tanggungan sesuai prinsip hukum harus menerapkan asas kepastian hukum, keadilan dan kemanfaatan / To minimize credit risk, creditors make collateral guarantees with liabilities. If the debtor is default, the creditor can sell the collateral through auction. Debtors / guarantor can submit a cancellation of the auction to the court. This research examines how the existence / standing of credit agreement deed and akta pemberian hak tanggungan due to the cancellation of auction based on the court decision and how the contents of the court's decision if there is a claim demanding the cancellation of the auction rights associated with the credit agreement deed and akta pemberian hak tanggungan. In this study, data collection was carried out using a statutory approach and also a case approach, by interviewing banks and judges as resource persons to answer the above problems. The results of the study concluded, that the credit agreement deed and akta pemberian hak tanggungan still binding back to the parties after the cancellation of auction based on the court decision and the contents of court decisions regarding cancellation of auction associated with the credit agreement deed and akta pemberian hak tanggungan according to the principle the law must apply the principle of legal certainty, justice and expediency
