Abstract

Pada zaman ini dunia dihadapkan dengan kemajuan teknologi informasi yang memberikan perbedaan dengan zaman dahulu. Teknologi informasi dan media elektronika dinilai sebagai simbol pelopor, yang akan mengintegrasikan seluruh sistem dunia, baik dalam aspek sosial, budaya, ekonomi dan keuangan. Dengan semakin berkembangnya teknologi memberikan dampak baik dan juga dampak buruk, oleh karena itu pemerintah membuat Undang-Undang Republik Indonesia Nomor 19 Tahun 2016 Tentang Perubahan Atas Undang-Undang No 11 Tahun 2008 Tentang Informasi Dan Transaksi Elektroik. Atau dikenal dengan UU ITE. Bahwa dalam UU ITE mengatur perbuatan yang dilarang yaitu ilegal akses. Dalam penelitian ini penulis melakukan penelitian terkait ilegal akses melalui dua putusan pengadilan negeri yang penulis kaji yaitu Studi Putusan Nomor: 414/Pid.B/2021/PN.Jkt.Pst. dan Studi Putusan Nomor : 9/Pid.Sus/2021/PN.Pli. Penelitian ini bertujuan untuk mengkaji ketersediaan dan penerapan hukum terkait ilegal akses berdasarkan UU ITE/At this time the world is faced with advances in information technology that makes a difference from the past. Information technology and electronic media are considered as symbols of pioneers, which will integrate the entire world system, both in social, cultural, economic and financial aspects. With the development of technology, it has both good and bad impacts, therefore the government made Law of the Republic of Indonesia Number 19 of 2016 concerning Amendments to Law No 11 of 2008 concerning Information and Electronic Transactions.
