Abstract

Setiap akhir tahun pemerintah pusat akan menetapkan panduan bagi pemerintah daerah untuk menetapkan Upah Minimum Provinsi. Penetapan UMP dilakukan oleh kepala daerah, baik gubernur, walikota atau bupati sebagai kepala daerah. Dasar penetapan UMP Provinsi selalu didasarkan kepada parameter yang ditetapkan oleh Pemerintah Pusat, dan parameter yang ditetapkan oleh pemerintah pusat akan sejalan dengan ketentuan peraturan perundang-undangan. Untuk tahun anggaran 2020 dan 2021 merupakan tahun yang sangat berat pasca terjadinya bencana Covid-19 yang melanda dunia termasuk di Indonesia. Oleh sebab itu sejak terjadinya bencana Covid-19 tahun 2019 sampai 2020 mempunyai dampak baik bagi pelaku usaha dan bagi tenaga kerja sendiri. Banyak perusahaan terpaksa merumahkan pegawainya, terjadinya pemutusan hubungan kerja massal atau terjadinya bekerja dari rumah (work from home). Bencana Covid-19 membuat semua pihak merasa tidak nyaman. Pengusaha tidak dapat bekerja secara maksimal karena adanya pembatasan kerja melalui WFH, dan di sisi lain tenaga kerja tidak dibayar penuh karena bekerja dari rumah. Berdasarkan hal ini kebutuhan gaji atau upah bagi tenaga kerja sangat dibutuhkan secara optimal. Untuk itu tindakan administratif kepala daerah dalam menetapkan UMP Tahun 2021 sangat dinantikan oleh pihak tenaga kerja dan pelaku usaha. Kedua belah pihak berharap penetapan UMP akan berpihak kepada pelaku usaha atau tenaga kerja. Untuk itu diperlukan kebijakan yang cermat dan hati2 bagi kepala daerah dalam menetapkan UMP Tahun 2021. Dalam penelitian ini penulis menyimpulkan bahwa tindakan atau kebijakan kepala daerah dalam menetapkan UMP Tahun 2021 mempunyai implikasi bagi tenaga kerja, pelaku usaha dan bagi pemerintah daerah sendiri. Penulis menyarankan agar penetapan upah minimum provinsi oleh Kepala Daerah tetap berpegang pada ketentuan peraturan perundang-undangan dan mempunyai aspek bagi semua./ At the end of each year, the central government will set guidelines for regional governments to determine the Provincial Minimum Wage(UMP). UMP is determined by regional heads, whether governors, mayors or regents as regional heads. The basis for determining the Provincial UMP is always based on the parameters set by the Central Government, and the parameters set by the central government will be in line with statutory provisions. For the 2020 and 2021 fiscal years, it was a very difficult year after the Covid-19 disaster that hit the world, including in Indonesia. Therefore, since the occurrence of the Covid-19 disaster in 2019 to 2020, it has had a impact not only on business owner but also on the workforce. Many companies have been forced to lay off their employees, and there have been mass layoffs or work from home (WFH). The Covid-19 disaster made all parties feel uncomfortable. Employers cannot work optimally because of work restrictions through WFH, and on the other hand workers are not fully paid because they work from home. Based on this, the need for salaries or wages for workers is required optimally. For this reason, the regional head's administrative actions in setting the 2021 UMP are highly anticipated by the workforce and business owners. Both parties hope that the determination of the UMP will favor businesses or workers. For this reason, careful and prudent policies are needed for regional heads in setting the 2021 UMP. In this study the authors conclude that the actions or policies of regional heads in setting the 2021 UMP have implications for workers, business actors and for the local government itself. The author suggests that the determination of the provincial minimum wage by the Regional Head adheres to the provisions of laws and regulations and has an aspect for all parties.
