Abstract

Minyak dan gas bumi (migas) merupakan sektor usaha yang mampu memberikan sumbangan bagi pertumbuhan ekonomi nasional. Tata kelola pengelolaan migas dilakukan oleh pemerintah berdasarkan wewenang atribusi yang diberikan kepada SKK Migas. Kontraktor Kontrak Kerjasama yang selanjutnya disebut KKKS adalah pihak yang diberi hak eksklusif atas kontrak kerja sama dengan pemerintah untuk melaksanakan eksplorasi dan eksploitasi di wilayah kerjanya. Pelaku usaha yang dapat dikategorikan sebagai KKKS adalah kontraktor yang mempunyai modal besar dan transportasi memadai di industri hilir migas. Salah satu upaya pemerintah untuk percepatan usaha migas di Indonesia adalah menciptakan sistem online single submission (OSS). OSS merupakan sistem pelayanan perizinan yang dikembangkan Kementerian Investasi/BKPM dengan memanfaatkan teknologi informasi berupa dokumen elektronik yang mengintegrasikan pemerintah pusat dan daerah untuk mempercepat pelaksanaan berusaha. Izin usaha adalah wujud legalitas yang diberikan pemerintah kepada pelaku usaha. Dengan diundangkannya Undang-Undang Nomor 11 Tahun 2020 tentang Cipta Kerja maka sistem OSS diubah menjadi Perizinan Berusaha Berbasis Resiko dengan pembagian usaha berdasar tingkat risiko dari skala kegiatan usaha. Penelitian ini dilaksanakan dengan menggunakan jenis penelitian yuridis normatif dimana bahan hukum yang penulis kumpulkan dianalisis secara kualitatif berdasarkan peraturan perundang-undangan. Metode pengumpulan bahan hukum yang penulis lakukan adalah dengan menggunakan pengamatan, serta studi kepustakaan dengan pendekatan sinkronisasi hukum dan asas-asas hukum. / Oil and natural gas is a business sector which capable of contributing to national economic growth. Governance of oil and gas management is carried out by the government based on the attribution authority given to SKK Migas. Cooperation Contract Contractors, hereinafter referred to as KKKS, are parties that are given exclusive rights to cooperation contracts with the government to carry out exploration and exploitation in their work areas. Business actors that can be categorized as KKKS are contractors who have large capital and adequate transportation in the downstream oil and gas industry. One of the government's attempt to accelerate the oil and gas business in Indonesia is to create an online single submission (OSS) system. OSS is a licensing service system developed by the Ministry of Investment/BKPM by utilizing information technology in the form of electronic documents that integrate the central and regional governments to accelerate business implementation. Business permits are a form of legality granted by the government to business actors. By issuing Law Number 11 of 2020 concerning Job Creation, the OSS system has been changed to a Risk-Based Business Licensing with business distribution based on the risk level of the scale of business activity. This research was carried out using a normative juridical research type where the legal materials collected by the author were analyzed qualitatively based on statutory regulations. The author's method of collecting legal material is by using observation, and literature studies with a legal synchronization approach and legal principles.
