Abstract

Perkembangan wisata kapal pesiar adalah wisata yang mengombinasikan antara bisnis transportasi dan akomodasi di dalam kapal pesiar selama pelayaran yang semakin meningkat setiap tahunnya. Wisata kapal pesiar yang menawarkan hiburan dan rekreasi di atas kapal pesiar selama beberapa hari kian diminati oleh masyarakat secara global. Carnival Corporation & PLC adalah perusahaan kapal pesiar terbesar dengan menawarkan kapal pesair dengan tujuan pelayaran yang berbeda-beda di setiap kapal pesiar nya. Perkembangan wisata kapal pesiar ini membangkitkan minat tenaga kerja Indonesia untuk bekerja diatas kapal pesiar dalam sistem manajemen hotel di atas kapal pesiar. Kondisi ini menimbulkan konsekuensi dari setiap kebijakan dan langkah-langkah yang harus ditempuh agar pemerintah Indonesia melaksanakan perlindungan terhadap tenaga kerja Indonesia yang bekerja pada kapal pesiar internasional atau dapat disebut juga sebagai tenaga kerja migran Indonesia yang bekerja pada kapal pesiar dengan bendera kenyamanan yang berbeda antara setiap kapal pesiar mendapatkan jaminan atas hak-hak dasar pekerja dan menjamin kesempatan serta perlakuan yang sama agar terwujudnya kesejahteraan pekerja para tenaga kerja Indonesia yang bekerja pada kapal pesiar internasional baik melalui hubungan diplomatik dan/atau konsuler maupun melalui prinsip ekstrateritorial. Metode pengumpulan data yang penulis lakukan adalah dengan menggunakan studi kepustakaan dengan pendekatan teoritis, konseptual, peraturan perundang-undangan serta konvensi-konvensi internasional mengenai ketenagakerjaan, pelayaran, perkapalan dan kepelautan. / The development of cruise ship tourism is a tour that combines transportation and accommodation businesses on cruise ships during cruises which is increasing every year. Cruise line tours that offer entertainment and recreation on cruise ships for several days are inscreasingly in demand by the global community. Carnival Corporation & PLC is the largest cruise line company by offering cruise ships with different cruise destinations on each cruise line has aroused the interest of Indonesian workers to work on cruise line in the hotel management system on cruise line. This condition raises the consequences of every policy and steps that must be taken so that the Indonesian government implements protection for Indonesian workers that working on international cruise line or reffered to as Indonesian migran workers who work on cruise line with the difference flag convenience each cruise ships are guarantee equal opportunities and treatment so that the welfare of Indonesian workers that working on international cruise line is realized through diplomatic and/or consular relations as well as through extraterritorial principles. The method of data collection that the author uses is to use a literature study with a theoretical approach, conceptual approach, Indonesian law and international conventions regarding employment, cruise line, and maritime labour.
