Abstract

The current tightness of business creates various problems in the brand. There are so many laws that regulate brands but there are still frequent collisions that create disputes. The most common problem regarding the brand is the similarity of the name. Not a few of these brands were also denied registration by the Directorate General of Intellectual Property Rights. Law Number 20 of 2016 Concerning Trademarks and Geographical Indications plays a very important role in regulating Trademark Disputes in Indonesia. Trademark registrants who object to the denial of trademark registration can appeal the refusal to the Trademark Appeal Commission. In this research, data collection was carried out by conducting a case study based on Supreme Court Decision Number 1032 K/Pdt.Sus-HKI//2020 about the refusal to register the trademark "Paloma High Quality Sanitary Hardware" against the Mark Appeal Commission at the Directorate General of Intellectual Property. The purpose of this study is to deepen knowledge regarding the criteria for refusal of trademark registration, especially Article 21 paragraph 1 letter a Law Number 20 of 2016 Concerning Trademarks and Geographical Indications and to obtain information regarding the application of Law Number 20 of 2016 concerning Trademarks and Geographical Indications in the settlement of refusal to register the trademark "Paloma High Quality Sanitary Hardware" of the Decision on Case Number 1032 K/Pdt.Sus-HKI//2020, based on Article 21 paragraph 1 letter a Law Number 20 of 2016 Concerning Trademarks and Geographical Indications. Law Number 20 of 2016 concerning Trademarks and Geographical Indications has been properly implemented in the settlement of refusal to register the trademark "Paloma High Quality Sanitary Hardware". Justice and Protection of Intellectual Property Rights in this case have also been fulfilled for all parties involved. The refusal to the registration of the trademark "Paloma High Quality Sanitary Hardware" aims to avoid the occurrence of branding that can harm the party entitled to the Intellectual Property.
