Abstract

Asuransi pada dasarnya adalah pihak yang menerima pengalihan resiko dari pihak tertanggung. Tertanggung membayarkan premi kepada pihak asuransi yang kemudian resiko pada objek yang di asuransikan di tanggung oleh pihak penanggung. Tertanggung merupakan pemegang polis dalam perusahaan asuransi.Dimana pemegang polis tersebut harus dilindungi oleh hukum yang berlaku manakala perusahaan asuransi menjadi pailit atau dilikuidasi. Tugas Akhir ini memiliki tujuan untuk mengetahui perlindungan hukum bagi pemegang polis terhadap perusahaan asuransi yang telah dicabut izin usahanya,Penulisan ini menggunakan metode penelitian Yuridis Normatif. Penulisan Tugas Akhir ini menganalisa kasus pada PT. Asuransi Jiwa Bakrie yang telah dicabut izin usahanya oleh Otoritas Jasa Keuangan. Dalam pembahasan PT. Asuransi Jiwa Bakrie memiliki kewajiban untuk membayar ganti kerugian kepada pemegang polis. Pemegang polis mendapatkan hak untuk mendapatkan ganti kerugian sesuai dengan Pasal 52 Undang - Undang Nomor 40 Tahun 2014 tentang perasuransian, Pasal 30 Undang – Undang Nomor 21 Tahun 2011 Tentang Otoritas Jasa Keuangan, dan Pasal 19 Undang – Undang Nomor 8 Tahun 1999 Tentang Perlindungan Konsumen. / Insurance is a party that receives a risk transfer from the insured party. The insured pays the premium to the insurer and then the risk to the insured object is borne by the insurer. The insured is a policyholder in an insurance company. Where the policyholder must be protected by applicable law when the insurance company becomes bankrupt or liquidated. This Final Project aims to find out the legal protection for policyholders against insurance companies that have had their business licenses revoked, this writing uses the Normative Juridical research method. The writing of this Final Project analyzes the case at PT. Bakrie Life Insurance has revoked its business license by the Financial Services Authority. In the discussion of PT. Bakrie Life Insurance must pay compensation to the policyholder. Policyholders get the right to get compensation by Article 52 of Law Number 40 of 2014 concerning insurance, Article 30 of Law Number 21 of 2011 concerning the Financial Services Authority, and Article 19 of Law Number 8 of 1999 concerning Consumer Protection.
