Abstract

Since 2020, the toll of COVID-19 pandemic has caused a surge in demand for spaces on cemetery grounds. This research is centred around the inquiries of the spatial planning law used in confirming COVID-19 cemetery land in Special Capital Region of Jakarta and its law implementation. This research was conducted through normative judicial method by qualitatively analyzing secondary judicial data and non-judicial data. Research shows that the increase in COVID-19 deaths and the decrease in available COVID-19 cemetery grounds had urged the Special Capital Region of Jakarta Regional Government to designate six new COVID-19 cemetery grounds with two Green Open Space (RTH) among them in East Jakarta. In Special Capital Region of Jakarta, spatial planning is regulated by Regional Regulation of the Special Capital Region of Jakarta Number 1 of 2012 concerning Provincial Territorial Layout Plan. In practice, some of the confirmations of COVID-19 cemetery grounds did conform to the law when some did not in the case of cemetery grounds planned on Green Open Space. Therefore, in the near future, the Special Capital Region of Jakarta Regional Government is obligated to comply with the regulations and environmental factors in choosing COVID-19 cemetery grounds to ensure long-term availability without harming surrounding areas.
