Abstract

Along with the development of the times, human needs are also increasingly developing, especially for women, namely the need for cosmetics. Cosmetics are a necessity for women to appear more attractive in order to develop a bolder personality in public. At present, the emergence of cosmetic products is very rapid, so it cannot be denied that it is in line with the emergence of increasing risks, such as the existence of illegal cosmetic products that are made using harmful ingredients. Irresponsible business actors who are only concerned with business interests in order to obtain the maximum profit. This action will certainly have a detrimental impact on consumers who continuously consume cosmetic products that are not in accordance with statutory regulations. The method used to overcome this problem is the government, together with BPOM as the supervisor, jointly handle the problem of distribution of illegal cosmetics made using dangerous ingredients. Therefore, in this study the authors are interested in analysing consumer legal protection by referring to BPOM’s role in supervising cosmetic products. Law No. 8 of 1999 concerning Consumer Protection and Law No. 36 of 2009 concerning Health is the benchmark for statutory regulations that will be used in this study. The method of data collection used in research is using literature obtained from legislation, books, journals, research results, websites supported by the collection of information obtained directly in the form of interviews with BPOM Tangerang Regency. The task of BPOM is to supervise the initial manufacture of cosmetics, distribution by issuing distribution permits to cosmetic promotion advertisements. The efforts that can be made by consumers to overcome the distribution of illegal cosmetics containing hazardous materials are by getting used to paying attention to product information before buying cosmetic products by conducting CLICK checks and helping to report business actors who act not in accordance with applicable regulations to BPOM.
